What is happening?

THE BOROUGH OF BLACKBURN WITH DARWEN

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT

MODIFICATION ORDER TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257

WILDLIFE COUNTRYSIDE ACT 1981, SECTION 53A(2) FP'S 51, 52 AND 80 BLACKBURN PUBLIC PATH DIVERSION ORDER 2024

On 25th July 2024 Blackburn with Darwen Borough Council confirmed I without modifications the above order made on 21st March 2024 under section 257 Town and Country Planning Act 1981. The effect of the order as confirmed is to divert the public footpath as described in Schedule 1 to this Notice onto the route described in Schedule 2 and as shown on the Order Map.

A copy of the Order and Map may be examined at the Public Notice Board inside Blackburn Town Hall and by request to view at Darwen Town Hall reception. Copies of the Order may also be obtained by making a request to: Public.RightofWay@BLACKBURN.GOV.UK. The order comes into force on 25th July 2024, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice, make an application to the High Court.

SCHEDULE 1 - LINE OF EXISTING ROUTE Footpath 51 Blackburn

From Point A on Phillips Road (SD 70308 30187) in a south easterly direction to its junction with Lower Phillips Road at Point B (SD 70278

30165) then in a southerly direction to Point C (SD 70310 30097) then in a generally easterly direction to Point D (SD 70358 30116) then in a south easterly direction to join FP 52 at Point E (SD 70489 29973), a total distance of 365 metres.

Footpath 52 Blackburn

From FP 80 at Point F (SD 70344 29817) in a south easterly direction to Point G (SD 70371 29903) then in a north easterly direction via its junction with FP 51 to Point H (SD 70517 29991) and then in a north north-easterly direction to the borough boundary at Point I (SD 70629 30170), a total distance of 412 metres.

Footpath 80 Blackburn

From Lower Philips Road at Point J (SD 70119 29885) in a south easterly direction along an industrial access road to Point K (SD 70276 29800) and then in a north easterly direction to join FP 52 Blackburn at Point F, a total distance of 315 metres.

SCHEDULE 2 - LINE OF DIVERSIONARY ROUTE

Footpath 51 Blackburn

From Phillips Road at Point A in a south easterly direction to its junction with Lower Phillips Road at Point B then in a southerly direction to join FP's 52 & 80 at Point L (SD 70315 30071), a total distance of 144 metres. Footpath 52 Blackburn From its junction with FP's 51 & 80 at Lower Phillips Road at Point L in a south easterly direction to Point M (SD 70419 30017) then in a north easterly direction across a site access to Point N (SD 70428 30028) then in a south easterly direction to Point O (SD 70490 29992) then in an easterly direction to Point P (SD 70524 30006) then in a North easterly direction to the borough boundary at point I, a total distance of 440 metres.

Footpath 80 Blackburn

From Lower Philips Road at Point J in a north easterly direction along the southern footway of Lower Philips Road to join FP's 51 & 52 at Point L, a total distance of 284 metres.
