What is happening?
THE HIGHLAND COUNCIL
TREE PRESERVATION ORDER NO. HC144, 2023 LAGGAN HOUSE, SCANIPORT, INVERNESS
NOTICE IS HEREBY GIVEN in terms of Regulation 6 of the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations, 2010 that The Highland Council confirmed The Highland Council Tree Preservation Order No. HC144, 2023 Laggan House, Scaniport, Inverness on 11 January 2024.
The reason for confirming the Order: tree felling within the area marked W1 (felled timber was within Scottish Forestry’s felling permission exemptions) following an application for planning permission in principle for a single dwelling house that was withdrawn following advice that the application would be unlikely to be supported. A site inspection concluded that the remaining trees were of high value and worthy of protection and that the formation of access into the site could have caused damage to roots of significant trees. There has been support for the serving of TPO from local residents, the Local Community Council, Scottish Forestry and Highland Council Members. The Order will allow the Council to protect this feature as well as encouraging appropriate longer-term management.
The Order was confirmed with a modification to the title description contained in the First Schedule. The Order applies to: the trees (of whatever species) standing within the areas marked W1 and W2 and shown within continuous red lines on the Map annexed to the Order. A certified copy of the Order has been deposited for inspection on the Council’s website: www.highland.gov.uk
