Notice is hereby given that an application for a Development Consent Order under section 37 of the Planning Act 2008 has been made by Indaver Rivenhall Ltd (company number: 13020091) (‘the Applicant’) of registered office Harlow Enterprise Hub, Kao Hockham Building, Edinburgh Way, Harlow, Essex, England, CM20 2NQ to the Planning Inspectorate (on behalf of the Secretary of State) (‘the Application’).
The Application was made on 10 November 2023 and accepted for examination by the Planning Inspectorate (on behalf of the Secretary of State) on 08 December 2023 (Application Reference: EN010138). The Application is for the extension of the generating capacity of the Energy from Waste (‘EfW’) plant forming part of the Rivenhall Integrated Waste Management Facility (‘IWMF’).
Summary of the Proposed Development
The site of the Proposed Development is land within the former Rivenhall Airfield north west of Kelvedon, Essex. The Rivenhall Integrated Waste Management Facility (‘IWMF’) is currently being constructed in accordance with planning permission granted pursuant to the Town and Country Planning Act 1990 (as amended) by Essex County Council (ECC ref: ESS/34/15/BTE, dated 26 February 2016). The planning permission allows the IWMF to generate up to 49.9 megawatts of electrical energy (‘MW’).
The Proposed Development involves engineering operations to allow the EfW plant within the Rivenhall IWMF to generate above 50MW. The engineering operations involve either: (1) modifications to the actuated steam turbine inlet control valves; or (2) the installation and commissioning of unrestricted actuated steam turbine inlet control valves. Which engineering operation is carried out will depend on the timing the works are carried out respective to the construction and commissioning of the Rivenhall IWMF. Both works would result in the EfW plant being able to generate more than 50 megawatts.
The works would be carried out to internal plant only. There would be no change the in amount or type of waste that is processed and/or incinerated at the IWMF. As a result, air quality and transport effects associated with the IWMF that is currently under construction will not change as a result of the Proposed Development. The appearance of the IWMF will also not change.
The Proposed Development is considered a 'Nationally Significant Infrastructure Project ('NSIP') under Sections 14(1)(a) and 15(1)(2)(a) to (c) of the PA 2008 as an extension of an onshore generating station in England (i.e. the EfW facility), which when extended, would have a capacity exceeding 50MW.
Environmental Impact Assessment
The Proposed Development is Environmental Impact Assessment development, as defined by the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 and, accordingly, an Environmental Statement accompanies the Application.

Making a representation
Any person may make representations on the Application to the Secretary of State (including giving notice of any interest in, comment on, objection to or support for the Application). All representations relating to the Application must be made on the Planning Inspectorate’s Registration and Relevant Representation Form and give the grounds on which it is made.
