Peterborough - Designation of an Area for Selective Licensing
What is happening?

DESIGNATION OF AN AREA FOR SELECTIVE LICENSING SECTION 80, HOUSING ACT 2004
Notice is hereby given that Peterborough City Council in exercise of its powers under Section 83 of the Housing Act 2004 (“the Act”) has on the 5th Day of December 2023 designated for selective licensing areas of Central, North, East, Park, Bretton, Fletton and Stanground Fletton and Woodston, Paston and Walton, Stanground South and Orton Waterville as delineated on the Maps at Annex A.
The designation shall come into force on 11th March 2024 and shall cease to be of effect on 10th March 2029. The addresses included in the designation are listed below in Annex B.
The designation shall be known as Peterborough Designation of Areas for Selective Licensing 2023. The designation applies to any privately rented property subject to any statutory exceptions set out below:
a) The property is a house of multiple occupation that is required to be licensed under Part 2 of the Act
b)The tenancy or licence of the property has been granted by a registered social landlord under Part 1 of the Housing Act 1996;
c) The property is subject to a temporary exemption under section 86 of the Act; or
d)The property is occupied under a tenancy or licence which is exempt under the Act or the occupation of is of a building or part of a building so exempt as defined in The Selective Licensing of Houses (Specified Exemptions) (England) Order 2006 SI 370/2006
Upon the Designation coming into force on 11th March 2024 any person who operates a licensable property without a licence is liable to prosecution and upon summary conviction liable to an unlimited fine. A person who breaches a condition of a licence is liable to prosecution and upon summary conviction liable to a fine.
The Minster of State for Levelling Up under the power conferred by section 82(2) of the Act hereby confirms the scheme described above.
Subject to sub paragraphs (a) to (d) listed above, every house in the area specified in Annex A, that is occupied under a tenancy or licence shall be required to be licensed under section 85 of the Act.
Peterborough City Council will comply with the notification requirements contained in section 83 of the Act and shall maintain a register of all houses registered under this designation as required under section 232 of the Act.
All landlords, managing agents or tenants within the designated areas should obtain advice to ascertain whether their property is affected by the Designation at:
