What is happening?
Notice under s.3 of the Reverter of Sites Act 1987
The former Winterborne Stickland school in the County of Dorset.
1. The Trustees hold land under a deed dated 5 December 1859. The deed was made under the provisions of the School Sites Acts and settled the land upon trust for use for the purposes of a school. On ceasing to be used for these purposes there was a provision for the land to revert to the original owner, and to form part of their estate.
2. The donor was Charles Joachim Hambro, Baron Hambro of Milton Abbas.
3. The land ceased to be so used and by virtue of section 1 of the Reverter of Sites Act 1987 became subject to a trust for the persons who but for that Act would from time to time be entitled to the ownership of the land by virtue of its reverter ("the beneficiaries").
4. The Trustees propose to apply to the Secretary of State for Education for an Order under section 554 of the Education Act 1996 with respect to the property subject to the said trust which will:
a. Extinguish the rights of the beneficiaries under the trust; and
b. Require the Trustees to hold the said property on the Uniform Statutory Trusts. The Uniform Statutory Trusts are set out in schedule 36 to the said Act and enable the proceeds of sale to be applied to support church schools throughout the Diocese.
5. Any beneficiary under the trust who wishes to oppose the extinguishment of his/her rights should notify his/her claim in writing to Jane Grenfell, LBMW LLP solicitors, 1 The Sanctuary, Westminster, SW1P 3JT, or by email to jane.grenfell@lbmw.com, within three months from today.
