Roedd yr Hysbysiad Adfer a gyhoeddwyd ar 07/04/22 yn nodi bod
gweithgarwch perygl llifogydd anawdurdodedig wedi’i gyflawni yn 4 Forest
Walk, Tonysguboriau, Pont-y-clun, sef adeiladu arglawdd pridd uwch ger Afon
Elái (prif gwrs dwˆ r yr afon), ac mai’r apelydd yw perchennog yr eiddo hwn a/
neu’r person sy’n gyfrifol am y gweithgarwch perygl llifogydd anawdurdodedig.
Mae’r gweithgarwch yn gyfystyr â gweithgarwch perygl llifogydd o fewn yr
ystyr ym mharagraff 3 Rhan 1 Atodlen 25 Rheoliadau Trwyddedu
Amgylcheddol (Cymru a Lloegr) 2016 gan ei fod yn debygol o ddargyfeirio
neu rwystro dwˆ r llifogydd Afon Elái.
Roedd yr Hysbysiad yn ei gwneud yn ofynnol i’r Apelydd gymryd y camau a
nodir yn Atodlen 1 erbyn y dyddiad(au) a nodir:-
1. Gwaredu’r arglawdd uwch yn gyfan gwbl ar hyd Afon Elái fel y nodir yn yr
Hysbysiad (erbyn 30 Mehefin 2022).
2. Adfer lefelau gwreiddiol y tir (cyn y gwaith adeiladu) yn cynnwys y glannau/
mannau y tarfwyd arnynt/a ddifrodwyd o ganlyniad i adeiladu’r arglawdd
uwch (erbyn 30 Mehefin 2022).
3. Darparu tystiolaeth ffotograffig o’r uchod i Cyfoeth Naturiol Cymru ar ôl
cwblhau’r gwaith a gwmpesir gan yr Hysbysiad (erbyn 30 Mehefin 2022).
Daw’r gweithgarwch perygl llifogydd dan sylw sy’n cwmpasu’r gwaith
anawdurdodedig o dan Baragraff 3(1)(f) Rhan 1 Atodlen 25 Rheoliadau
Trwyddedu Amgylcheddol (Cymru a Lloegr) 2016, sef;
f) Unrhyw weithgarwch o fewn 8 metr i brif afon heb lanw (neu o fewn 8
metr i amddiffynfa llifogydd neu gwlfert ar yr afon honno) neu unrhyw
weithgarwch o fewn 16 metr i brif afon â llanw (neu o fewn 16 metr i
amddiffynfa llifogydd neu gwlfert ar yr afon honno) sy’n debygol o:
a. achosi difrod neu beryglu sefydlogrwydd glannau’r afon honno neu
unrhyw gwlfert;
b. achosi difrod i unrhyw waith rheoli afonydd;
c. newid, ail-greu, terfynu neu ddileu unrhyw waith rheoli afonydd;
d. dargyfeirio neu rwystro dwˆ r llifogydd neu effeithio ar ddraeniad yr afon
honno; neu
e. ymyrryd â mynediad Cyfoeth Naturiol Cymru i ac ar hyd yr afon honno.

REGULATIONS 2016
NOTICE IS HEREBY GIVEN THAT
AN INSPECTOR APPOINTED BY
THE WELSH MINISTERS UNDER SECTION 114 OF THE
ENVIRONMENT ACT 1995 TO DETERMINE THE APPEAL
WILL HOLD A VIRTUAL INQUIRY2
ON
TUESDAY, 12TH DECEMBER 2023 at 10.00 a.m.
The Virtual Inquiry is being held into the appeal by CATHERINE DEVINE
against a FLOOD RISK ACTIVITY REMEDIATION NOTICE. Further details
are given below. The Inspector will hear evidence from the parties to the
appeal and, at the Inspectors discretion, hear representations from any other
person who may wish to appear and be heard. The inquiry is expected to sit
for 4 days.

Please use the case reference number CAS-01950-R2V0Q8 to access
the documents.
The Remediation Notice issued on 07/04/22, cited that an unauthorised flood
risk activity had been undertaken at 4 Forest Walk, Talbot Green, Pontyclun,
namely, the construction of a raised earth embankment adjacent to the River
Ely (Main river watercourse), and that the appellant is the owner of this
property and/or the person responsible for the unauthorised flood risk activity.
The activity constitutes a flood risk activity within the meaning of paragraph 3
of Part 1 of Schedule 25 of the Environmental Permitting (England and Wales)
Regulations 2016 by virtue of by virtue of it being likely to divert or obstruct
the flood waters of the River Ely.
The Notice required the Appellant to take the steps set out in Schedule 1 by
the date(s) specified:-
1. The removal of the entire raised embankment along the River Ely as set out
in the Notice (by the 30th June 2022).
2. The reinstatement of the original ground levels (pre-construction)
comprising the banks/areas which have been disturbed/damaged as a result
of the construction of the raised embankment (by the 30th June 2022).
3. To provide photographic evidence of the above to NRW upon completion
of the works covered by the Notice (by the 30th June 2022).
The flood risk activities in question that cover the unauthorised works are
under Paragraph 3(1)(f) of Part 1 of Schedule 25 of the Environmental
Permitting (England and Wales) Regulations 2016, namely;
f) Any activity within 8 metres of a non-tidal main river (or within 8 metres of
any flood defence structure or culvert on that river) or any activity within 16
metres of a tidal main river (or within 16 metres of any flood defence
structure or culvert on that river) which is likely to:
a. cause damage to or endanger the stability of the banks of that river or
of any culvert;
b. cause damage to any river control works;
c. alter, reconstruct, discontinue or remove any river control works;
d. divert or obstruct flood waters or impact on the drainage of that
river; or
e. interfere with Natural Resources Wales’ access to and along that river.
