What is happening?

LICENSING (NORTHERN IRELAND) ORDER 1996 (Article 22, SCHEDULE 5, PARAGRAPHS 1 AND 2)

Notice of Application for the transfer of a Licence.

Western Administrative Court Division

TAKE NOTICE that I Stephen St Ledger of 34 Clonliff Road, Macken, Enniskillen, County Fermanagh, BT92 3BT intend to apply at the Magistrates Court sitting at Enniskillen on the 22nd day of November 2023 at 10am for the transfer to me of a Licence at present held by Michael Maguire of 92 Marlbank Road, Florencecourt, County Fermanagh aforesaid for the premises situate at and known as 'Maguires Public House', 15 Main Street, Belcoo, County Fermanagh aforesaid being premises of the following kind according to the Licensing (Northern Ireland) Order 1996, namely premises specified in Article 5(1 )(a) ie. premises in which the business carried on under the licence is the business of selling intoxicating liquor by retail for consumption either in or off the premises.

A Protection Order authorising the said Stephen St Ledger to carry on business under the Licence was granted on the 2nd May 2023 by the Magistrates Court sitting at Enniskillen for the period of six months from the date of the Order.

I am the owner of the business carried on under the Licence.

The owner of the premises is the said Michael Maguire and Siobhan Maguire both of 92 Marlbank Road, Florencecourt, County Fermanagh aforesaid.

The Licence will be deposited with the Clerk of Petty Sessions before or at the hearing of the Application.

FURTHER TAKE NOTICE that any person owning or residing or carrying on business in premises in the vicinity of the premises For which the transfer of the Licence is sought who intends to object must in accordance with paragraph 41 of Schedule 5 of the said Order serve Notice of Intention to Object upon the Applicant and the Clerk of Petty Sessions not less than one week before the hearing of the Court application.

AND FURTHER TAKE NOTICE

that the permissible grounds of objection are specified in Article 22(6) of the said Order namely unfitness of the applicant, failure to comply with the correct procedure or that the business carried on in the premises under the Licence has been discontinued.
