What is happening?
PROPERTY (NORTHERN IRELAND) ORDER 1978
IN THE LANDS TRIBUNAL FOR NORTHERN IRELAND
TAKE NOTICE that THE TRUSTEES OF THE REFORMED PRESBYTERIAN CHURCH OF IRELAND, the owners and occupiers of the lands and premises situate at and known as the former Reformed Presbyterian Church, 26 Curran Road, Larne, BT40 1BU, held under a Fee Farm Grant (“the Grant”) dated 11th May 1903 and made between William Chaine of the one part and Rev. Samuel Hanna, John McCluggage, John Black Junior and James Buchanan of the other part (“the Lands”) by their solicitors, King & Gowdy of 298 Upper Newtownards Road, Belfast, BT4 3EJ, intend to make an application to the Lands Tribunal for Northern Ireland pursuant to Article 5 of the Property (Northern Ireland) Order 1978, for the following determinations:
An Order extinguishing in whole the covenants contained in the Grant, viz:-
1. “And also that the Grantees will not at any time during the continuance of this grant erect or build on the said granted premises any other house or other erection or building whatsoever except the building before mentioned and Sexton’s or Caretakers house without the previous consent in writing of the Grantor”
2. “… and also will not at any time open or construct any window or other opening in any gable or gables of the said Sexton or caretaker’s house”
3. “… and will not without such previous consent in writing permit or suffer the said premises or any building to be erected thereon to be used for the purposes of a public house inn tavern spirit grocery or beer shop or for the purposes of any shop trade business or manufacture whatsoever”
4. “… that the buildings to be erected on the said granted premises during the continuance of this Grant except as hereinafter mentioned shall be used only for Church purposes”
5. “And also that the Grantees will not at any time or times hereafter during the continuance of this Grant alien assign sublet or subdemise (except by way of Mortgage or except by way of assignment to new Trustees or Trustee and for the purposes of properly vesting in and assuring to the persons or person who are for the time being the Trustees”
6. “And also that the Grantees will not keep or suffer to be kept on the said granted premises any pig or cow poultry or other live stock without the previous consent in writing of the Grantor”
7. “Provided Nevertheless that such sale or sub-letting shall not in any case be made without the previous consent in writing of the Grantor and shall be made (in case such consent is granted) Subject to the increased rent of Twelve pounds hereinbefore referred”
Persons who wish to object to this application or to assert an interest in the Lands may do so by serving notice in writing upon the Registrar of the Lands Tribunal for Northern Ireland, Royal Courts of Justice, Chichester Street, Belfast, BT1 3JJ, on or before [DATE] together with details of (a) their interest in the Lands and (b) their grounds of objection (if any).
