What is happening?
IN THE HIGH COURT OF JUSTICE BUSINESS AND PROPERTY COURTS IN LEEDS PROPERTY, TRUSTS AND PROBATE LIST (ChD) Case Number PT-2025-LDS-000004 IN THE MATTER OF AN APPLICATION FOR A DECLARATION OF THE PRESUMED DEATH OF MR KIRK NIGEL HANDLEY AND IN THE MATTER OF AN APPLICATION MADE UNDER THE GUARDIANSHIP (MISSING PERSONS) ACT 2017 FOR A GUARDIANSHIP ORDER IN RESPECT OF MR KIRK NIGEL HANDLEY
A claim has been issued in the High Court of Justice, Business and Property Courts in Leeds, Property, Trusts and Probate List (ChD) Claim No. PT-2025-LDS-000004 by Mrs Julia Rachel Hughes for:
1. A declaration that Mr. Kirk Nigel Handley, whose last known address was 15 Moseley Wood Walk, Cookridge, Leeds LS16 7HQ is presumed to be dead.
2. Alternatively, an order that Mrs Julia Rachel Hughes be appointed guardian in respect of Mr Kirk Nigel Handley (“the missing person”), whose last usual place of residence was 15 Moseley Wood Walk, Cookridge, Leeds LS16 7HQ.
The date and venue for the first hearing of the Claim is 10 April 2025 at 2.30pm by Micosoft Teams at the High Court of Justice, Business and Property Courts in Leeds, Property, Trusts and Probate List (ChD), Leeds Combined Court Centre, Oxford Row, Leeds LS1 3BG
Any spouse, civil partner, parent, child or sibling of the missing person is entitled to intervene in the matter.
Any other person having an interest may apply to the Court to intervene in the matter.
If you wish to give notice of intention to intervene or to apply to the Court for permission to intervene, you should do so as soon as possible at the High Court of Justice, Business and Property Courts in Leeds, Property, Trusts and Probate List (ChD), Leeds Combined Court Centre, Oxford Row, Leeds LS1 3BG, and no later than 14 days before the date of the above hearing in relation to the application for a Guardianship Order and 21 days from the date of this notice in relation to the application for a declaration of presumed death. Delay may harm your prospects of obtaining permission to intervene if you are not entitled to intervene, and in any event may be taken into account on any question relating to costs.
