Brockwell Energy - Section 48 Planning Notice
What is planned?
SECTION 48 PLANNING ACT 2008
THE INFRASTRUCTURE PLANNING (APPLICATIONS: PRESCRIBED FORMS AND PROCEDURE) REGULATIONS 2009
REGULATION 4
CASTLE WAY ENERGY
NOTICE PUBLICISING A PROPOSED APPLICATION FOR A DEVELOPMENT CONSENT ORDER
Notice is hereby given that BSSL Derbyshire 1 Ltd (company number 15467612) (the “Applicant”), whose registered office is at Lamplighter Works – Third Floor, 49–51 Farringdon Road, London, United Kingdom, EC1M 3JB, proposes to apply to the Secretary of State for Energy Security and Net Zero under section 37 of the Planning Act 2008 for a Development Consent Order (“DCO”) authorising Castle Way Energy (the “Proposed Development”).
The Applicant is a wholly owned subsidiary of Brockwell Energy and was established to develop the Proposed Development.
The Proposed Development
The Proposed Development would comprise a solar photovoltaic (PV) electricity generating station capable of generating over 100MW Alternating Current (AC) of electricity with co-located Battery Energy Storage System (BESS). The Proposed Development is located within the administrative boundaries of South Derbyshire District Council, Derbyshire County Council and Derbyshire Dales District Council.
The Proposed Development requires development consent under the Planning Act 2008 on the basis that the proposed generating station will constitute a nationally significant infrastructure project (NSIP) under section 14(1)(a) and section 15 of the Planning Act 2008.
It may also require development consent on the basis that any proposed overhead electric lines may themselves constitute an NSIP under section 14(1)(b) and section 16 of the Planning Act 2008, where it is 132 kV or above and at least 2 km in length. Any overhead lines and/or underground cables that do not themselves constitute an NSIP will instead be included within the DCO as associated development to the NSIP.
The Proposed Development therefore constitutes an NSIP for which development consent is required under section 31(1) of the Act.
The Proposed Development includes the following elements:
• Seven solar development sites (Sites 1a, 1b, 2-6) which will include solar photovoltaic (PV) arrays and inverters;
• A central substation, BESS and associated infrastructure, located in Site 3;
• Underground and/or overhead cables to connect the solar development sites, BESS and associated electrical infrastructure to one another, and to the National Grid at the Willington 400kV substation;
• Accesses and internal access tracks required for construction, operation, maintenance and decommissioning;
• Temporary construction infrastructure, including construction compounds, laydown areas and staff welfare facilities;
• Fencing and security measures including closed-circuit television (CCTV);
• The intent to provide an area for environmental mitigation and an agrivoltaics research area to be delivered in partnership with an independent scientific research institute.
The Proposed Development is an Environmental Impact Assessment (EIA) development for the purposes of the Infrastructure Planning (EIA) Regulations 2017. This means that the proposed works constitute development for which an EIA is required and the proposed application for a DCO will therefore be accompanied by an Environmental Statement (ES). The Secretary of State adopted a Scoping Opinion for the Proposed Development on 28 July 2026.
