NOTICE OF DISPOSAL

DISPOSAL OF OPEN SPACE AT

THE ELGAR CENTRE 1A HIGH STREET UPTON NORTHAMPTON NN5 4EN

1.  NOTICE IS HEREBY GIVEN in pursuance of Section 123(2A) of the Local Government Act 1972 (as amended by the Local Government, Planning and Land Act 1980) that West Northamptonshire Council intends pursuant to Section 123 of Local Government Act 1972 to dispose of land described in the Schedule to this Notice by way of a Lease to The Lewis Foundation.

2.  In the event that the Open Spaces Act 1906 applies, the Council considers that the proposed Lease does not affect any statutory trust (if any) that may have arisen, given the presence of the property (which is the subject of the proposed Lease) was present on the land at the time the property was acquired. Further, the purpose of the Lease is for public and community benefit.

3.  Any objections to the intended disposal must be made in writing and addressed to the Director of Governance (Ref WNC DLE33650) West Northamptonshire Council, One Angel Square, 4 Angel Street, Northampton, NN1 1ED by no later than 28 days from the date of this notice.

4.  A plan showing the location of the land it is intended to dispose of may be inspected free of charge at the One Stop Shop, The Guildhall, St Giles Square, Northampton from 8:30 am to 5:00 pm on Mondays, Tuesdays, Thursdays and Fridays and from 10:00 am to 5:00 pm on Wednesdays or an electronic copy can be requested by emailing victoria.munnelly@westnorthants.gov.uk.
