Stoke-on-Trent - Planning Controls For Small Hmos

What is planned?

New city-wide planning controls for small HMOs in Stoke-on-Trent

Stoke-on-Trent City Council has made an Article 4 Direction which will introduce additional planning controls for small houses in multiple occupation (HMOs) across the city. The Direction applies to the whole of the administrative area of Stoke-on-Trent and will take effect on 23 October 2026.

At present, a property can generally change from a Class C3 dwellinghouse to a Class C4 small HMO under permitted development rights without the need for a planning application. The Article 4 Direction removes that permitted development right.

From 23 October 2026, anyone wishing to change the use of a property from a Class C3 dwellinghouse to a Class C4 HMO within Stoke-on-Trent will therefore need to apply to the Council for planning permission. Having an Article 4 Direction in place does not mean that HMOs are prohibited.

Instead, it means that the Council will be able to consider proposed changes of use through the normal planning application process.

The Direction has been made with immediate effect and is subject to the statutory consultation and confirmation process.

Representations on the Article 4 Direction are invited from 23 October 2026 until 20 November 2026. The Article 4 Direction, accompanying plan and supporting information can be viewed at the Civic Centre, Glebe Street, Stoke-on-Trent, ST4 1HH.

Representations can be made in writing for the attention of the Chief Planning Officer via email a planning. policy@stoke.gov.uk or by letter to Civic Centre, Glebe Street, Stoke-on-Trent ST4 1HH. Should you require assistance in making representations please contact the planning team via telephone on 01782 232595. All representations received during the consultation period will be considered by the Council before a decision is made on whether to confirm the Direction.
