NOTICE UNDER ARTICLE 13 OF APPLICATION FOR PLANNING PERMISSION

The Town and Country Planning (Development Management Procedure) (England) Order 2015

Proposed Development at: B&Q Site, Hull Road/Osbaldwick Link Road, York, YO10 3JA. Notification that: Legal and General Assurance (Pensions Management) Limited Is applying to the: City of York Council For Planning Permission to: (Description of proposed development) Alteration (including demolition), sub-division, extension and refurbishment (including repainting of facade), to the existing B&Q unit to create an additional retail unit, including a cafe, new canopies to main facade, service yard and garden centre, entrance lobbies, enclosures for substation and HV & EV electrical rooms and associated enclosure, an ATM enclosure, photovoltaic panels, plant enclosure, EV charging installations, reconfigured parking, cycle parking, relocated mobile catering van, landscaping (hard and soft), acoustic fence, signage zones, replacement main site signage totem, trolley bays and click and collect zone, reconfigured service and builder's yards (including delivery van parking), site wide lighting and associated access and highway improvement works.

Any owner* or tenant ** who wishes to make representations about this application should write to the Council at: Planning and Development Services, City of York Council, West Offices, Station Rise, York, YO1 6GA. By: 06th October 2026 that being 14 days beginning with the date of publication of this Notice. In the event that an appeal is made against a decision of the Council, and that appeal then proceeds by way of the expedited procedure under the written representations procedure to refuse to grant planning permission for the proposed development, and that appeal then proceeds by way of the expedited procedures unt the written representations procedure***, any representations made by the owner* or tenant** to the Council about this application will be passed to the Secretary of State and there will be no opportunity to make further representations. Any owner or tenant wishing to make representations should do so by the date given above. *'Owner' means a person having a freehold interest or leasehold interest the unexpired term of which is not less than seven years.

**'Tenant' means a tenant of an agricultural holding any part of which is comprised in the land.

***The expedited procedure in relation to written representations is set out in the Town and Country Planning (Appeals) (Written Representations Procedure) (England) Regulations 2009 (as amended) Signed:
