What is planned?
TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 2015, AS AMENDED
NON-IMMEDIATE DIRECTION MADE UNDER ARTICLE 4(1) TO WHICH ARTICLE 6 APPLIES
NOTICE IS GIVEN that MAIDSTONE BOROUGH COUNCIL made a Non-Immediate Direction on 15th September 2026 under Article 4(1) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
The Non-Immediate Direction relates to development consisting of conversions from Use Class E (commercial business and service) to Use Class C3 of Schedule 2 to the said 2015 Order (as amended).
The Non-Immediate Direction removes permitted development rights for this type of development from the date it comes into force namely 30th October 2026. Planning permission will therefore be required for development consisting of conversions from Use Class E (commercial business and service) to Use Class C3 being development comprised within office buildings to the said 2015 Order (as amended) of the following buildings:-
• Invicta House, Maidstone, Kent, ME14 1XX
• Medway Bridge House, Fair Meadow, Maidstone, Kent, ME14 1JP
• Meadow House, 28 High Street, Maidstone, Kent, ME14 1JF
• Kestrel House & Knightrider House, Knightrider Street, Maidstone, Kent, ME15 6LU
• County Gate One and Two, Staceys Street, Maidstone, Kent, ME14 1ST
as shown on the maps attached as Appendices A-E to the Direction on and after this date.
A copy of the Direction, including each plan defining the area covered, can be viewed on the Council’s website at https://maidstone.gov.uk/home/primary-services/planning-and-building/information/article-4-directions. Alternatively, an appointment can be made to view a paper copy by contacting Maidstone Borough Council by email to legalqueries@midkent.gov.uk.
Representations may be made concerning the Article 4 Direction between 18th September 2026 and 30th October 2026 inclusive. If you wish to make representations you may do so by email to LDF@maidstone.gov.uk
or by post to the Head of Planning and Economic Development, Maidstone House, King Street, Maidstone, ME15 6JQ, representations must be received by 5pm on 30th October 2026.
The Non-Immediate Direction comes into force on 30th October 2026 subject to being confirmed by the Council pursuant to paragraph 1(10) of Schedule 3 to the said Order.
