Argyll and Bute - Tree Preservation Order for Woodland at Portincaple

THE ARGYLL AND BUTE, PORTINCAPLE, HELENSBURGH, ARGYLL AND BUTE TREE PRESERVATION ORDER NO. 01/26

The above Authority under Section 160 of the Town and Country Planning (Scotland) Act 1997 has made a Tree Preservation Order which took effect on 9th September 2026 and hereby gives notice that:-

1. The Tree Preservation Order was made as it was considered expedient to ensure the protection of canopy woodland dominated by semi-mature to early-mature oak and birch trees at Portincaple, Helensburgh, Argyll and Bute and considered by the Local Planning Authority to be of considerable merit and contribute to the overall setting of the property and the local area; The woodland is considered to provide significant amenity in terms consistent with relevant Tree Preservation Order guidance and the Planning etc. (Scotland) Act 2006. In line with the strengthened policy presumption in favour of protecting biodiversity and ancient woodland, it is considered expedient in the wider public interest to secure the long-term retention, protection and recovery of this woodland resource.

2. A copy of the Tree Preservation Order and map has been deposited at Argyll and Bute’s Council Office at The Helensburgh and Lomond Civic Centre, 38 East Clyde Street, Helensburgh G84 7PG and may be inspected during all normal working hours;

3. Representation with respect to the Tree Preservation Order may be made to David Logan, Head of Legal and Regulatory Support, Kilmory, Lochgilphead, Argyll PA31 8RT by 15th October 2026 in accordance with Regulation 5 of the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 2010, which Regulations state that:-

(1) every representation to the Planning Authority with respect to an Order shall be made in writing, shall state the grounds thereof, and specify the particular trees, groups of trees, or woodlands in respect of which it is made.

(2) The planning authority must consider any representations made in accordance with this regulation before the tree preservation order is confirmed.

4. The Tree Preservation Order took effect on 9th September 2026 and shall expire 6 months after it is made unless it has, within that period, been confirmed by the Planning Authority.
