Notice of the Confirmation of a Non-Immediate Direction under Article 4 relating to Land at Rusthall Common Langton Road Royal Tunbridge Wells Kent

NOTICE IS GIVEN that TUNBRIDGE WELLS BOROUGH COUNCIL confirmed a Non-Immediate Direction on 9th September 2026 under Article 4(1) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended)

(i) The Non-Immediate Direction relates to development consisting of
Development consisting of the use of the land, other than a building, as a caravan site in the circumstances referred to in paragraph A.2. being development comprised within Class A of Part 5 of Schedule 2 to the said 2015 Order (as amended) and not being development comprised within any other Class.

(ii) Paragraph A.2 defines - The circumstances mentioned in Class A are those specified in paragraphs 2 to 10 of Schedule 1 to the Caravan Sites and Control of Development Act 1960 (cases where a caravan site licence is not required), but in relation to those mentioned in paragraph 10 do not include use for winter quarters.

The Non-Immediate Direction removes permitted development rights for this type of development from the date it came into force namely 31st May 2026. Planning permission will therefore be required for development referred to above.
