HYSBYSIAD O ORCHYMYN CAU PRIFFYRDD (TIR A ELWID GYNT YN THE OPEN HEARTH, HENDRE FARM DRIVE, CASNEWYDD) 2026

MAE GWEINIDOGION CYMRU wedi gwneud Gorchymyn o dan adran 247 o Ddeddf Cynllunio Gwlad a Thref 1990 (“Deddf 1990”) i awdurdodi cau’r darnau o briffordd a ddisgrifir yn Atodlen 1 i’r Hysbysiad hwn, i wella’r darn o briffordd a ddisgrifir yn Atodlen 2 i’r Hysbysiad hwn ac i ddarparu ar gyfer y darn newydd o briffordd a ddisgrifir yn Atodlen 3 i’r Hysbysiad hwn. Mae Gweinidogion Cymru wedi eu bodloni bod angen cau’r briffordd. Nid awdurdodir cau’r briffordd ond er mwyn gwneud y datblygiad yn unol â’r caniatâd cynllunio a roddwyd o dan Ran 3 o Ddeddf 1990 gan Gyngor Dinas Casnewydd ar 13 Mawrth 2026 o dan y cyfeirnod 25/0700 a ddisgrifir yn Atodlen 4 i’r Hysbysiad hwn.

Bydd Gorchymyn Cau Priffyrdd (Tir a Elwid Gynt yn The Open Hearth, Hendre Farn Drive, Casnewydd) 2026 (“y Gorchymyn”) yn peidio â chael effaith os daw’r caniatâd cynllunio mewn cysylltiad â’r datblygiad i ben neu os caiff ei ddirymu.

Mae’r Gorchymyn yn gwneud darpariaeth ar gyfer cadw hawliau ymgymerwyr statudol ar gyfer unrhyw gyfarpar o dan y briffordd, ynddi, arni, drosti, ar ei hyd neu ar ei thraws.

Gellir edrych ar gopïau o’r Gorchymyn a’r plan a adneuwyd yn rhad ac am ddim yn ystod oriau swyddfa arferol yn Swyddfa Bost Ringland, Uned 9-10, R1, Casnewydd, NP19 9EH, neu gellir eu cael yn rhad ac am ddim o’r cyfeiriad isod gan ddyfynnu’r cyfeirnod qA2429638.

Caiff unrhyw berson a dramgwyddir gan y Gorchymyn, ar y sail:

a. nad yw o fewn pwerau Deddf 1990, neu

b. na chydymffurfiwyd ag un o ofynion gweithdrefnol Deddf 1990;

o fewn 6 wythnos i 28 Awst 2026, wneud cais i’r Uchel Lys at y diben hwnnw.

2. Darn afreolaidd ei siâp o briffordd a leolir yn yr ardal barcio ar ddiwedd Hendre Farm Drive, Casnewydd NP19 9LH, gyda chyfanswm arwynebedd o 353 o fetrau sgwâr, wedi ei labelu’n “B”, ac wedi ei farcio â llinellau sebra ar y plan a adneuwyd.

Darn petryalog ei siâp o briffordd a leolir ar y tir a elwid gynt yn The Open Hearth, Hendre Farm Drive, Casnewydd NP19 9LH, sy’n mesur 7.5 metr yn y man lletaf a 57 o fetrau yn y man hiraf, gyda throetffordd 2 fetr ar un ochr a chyfleuster troi newydd, ac wedi ei farcio â chroeslinellau ar y plan a adneuwyd.

Y darn o briffordd sydd i’w wella
Darn afreolaidd ei siâp o briffordd ar Hendre Farm Drive, Casnewydd NP19 9LH, sy’n dechrau o’i chyffordd â Fred Edwards Close ac yn ymestyn i gyfeiriad y gorllewin, gyda chyfanswm ei arwynebedd yn 451 o fetrau sgwâr ac wedi ei farcio â dotwaith ar y plan a adneuwyd.

TOWN AND COUNTRY PLANNING ACT 1990

NOTICE OF STOPPING UP OF HIGHWAYS (LAND FORMERLY KNOWN AS THE OPEN HEARTH, HENDRE FARM DRIVE, NEWPORT) ORDER 2026

THE WELSH MINISTERS have made an Order under section 247 of the Town and Country Planning Act 1990 (“the 1990 Act”) to authorise the stopping up of the lengths of highway described in Schedule 1 to this Notice, to improve the length of highway described in Schedule 2 to this Notice and to provide for the new length of highway described in Schedule 3 to this Notice. The Welsh Ministers are satisfied that the stopping up is necessary, and it will be authorised only in order to enable the development to be carried out in accordance with planning permission granted under Part 3 of the 1990 Act by Newport City Council on 13 March 2026 with reference 25/0700 described in Schedule 4 to this Notice.

The Stopping Up of Highways (Land formerly known as the Open Hearth, Hendre Farm Drive, Newport) Order 2026 (“the Order”) ceases to have effect if planning permission in respect of the development expires or is revoked.

The Order makes provision for the preservation of rights of statutory undertakers for any apparatus under, in, on, over, along or across the highway.

Copies of the Order and the deposited plan may be inspected free of charge during normal office hours at Ringland Post Office, Unit 9-10, R1, Newport NP19 9EH, or may be obtained free of charge from the address below quoting reference qA2429638.

If a person is aggrieved by the Order, on the grounds that:

a. it is not within the powers of the 1990 Act; or

b. a procedural requirement of the 1990 Act has not been complied with;; that person may, within 6 weeks of 28 August 2026 make an application for the purpose to the High Court.

1. An irregular shaped length of highway located in the parking area at the end of Hendre Farm Drive, Newport NP19 9LH, with a total surface of 45 square metres, labelled “A”, and marked with zebra hatching on the deposited plan.

2. An irregular shaped length of highway located in the parking area at the end of Hendre Farm Drive, Newport NP19 9LH, with a total surface of 353 square metres, labelled “B”, and marked with zebra hatching on the deposited plan.

SCHEDULE 2
New highway to be provided

A rectangular shaped length of highway located on the land previously known as the Open Hearth, Hendre Farm Drive Newport NP19 9LH, measuring 7.5 metres at its widest point and 57 metres at its longest point, with a 2 metres footway on one side and a new turning facility, and marked with cross hatching on the deposited plan.

Length of highway to be improved
