PUBLIC NOTICE by Westminster City Council
Notice is hereby given that on the date 13 August 2026 Westminster City Council made The City of Westminster (Stopping Up of Highways) (No.6) Order 2026 under sub-sections 247 (2A), (2B) and (3) of the Town and Country Planning Act 1990, the general effect of which is to authorise the stopping up parts of the highway Cavendish Square to enable the development comprising the re-aligning of the boundary of CAVENDISH SQUARE GARDENS, CAVENDISH SQUARE, LONDON, W1G 0PR, and the car park situated there underneath.
The part of the highway that the order authorises to be stopped up:
(a) comprises a total area of 370.3 square metres in the horizontal plane,
(b) extends in six parts, namely:
(i) save for the existing enclosed land at this location, the 51.5 square metres elliptical area the major axis of which extends 12.1 metres due north and its minor axis extends 8.7 metres due east and the centre of which is situated 11.8 metres northwest of the perimeter wall of the said gardens;
(ii) the 82.5 square metres elliptical area the major axis of which extends 12.1 metres due north and its minor axis extends 8.7 metres due east and the centre of which is situated 13.1 metres north east of the perimeter wall of the said gardens;
(iii) the 114.6 square metres area that extends from the 24.6 metres length of the perimeter wall of the said gardens by a distance that varies from 6.6 metres due south-west and 2.3 metres at its south most end;
(iv) the 23.9 square metres area that abuts the south most length of the perimeter wall of the said gardens and extends by 3.6 metres due south and 7 metres due east;
(v) the 60.3 square metres area that extends from the 30.7 metres length of the perimeter wall of the said gardens by a distance that varies from 2.2 metres south-south-eastward and 1.9 metres due south east;
(vi) the 37.5 square metres area that extends from the 8.9 metres length of the perimeter wall of the said gardens by a distance 1.9 metres due south-east along its 5 metres west most length then by a distance that varies anti-clockwise from 7 metres to 6.4 metres due south-east along its east most length;
Pursuant to sub-section 247 (2B) of the Town and Country Planning Act 1990, the order also provides for highway improvements, Those Highway Improvements shall comprise a total area of 375.4 square metres in the horizontal plane and extend as follows, namely:
(a) the 14.9 square metres area adjacent to the western side of the area of highway to be stopped up to which the above article 3 (b)(i) refers and extends 6.9 metres due north and varying from 2.7 metres due east at its northern and southern ends and 1.9 metres due east and situated midway adjacent to the existing enclosed land; and
(b) proceeding in an anti-clockwise orientation approximately parallel to the perimeter wall of the said gardens an arc 68.1 metres long commencing 3.7 metres eastward and 2.2 metres southward of the south most point of the perimeter wall of the said gardens, the 360.4 square metres area that extends by a distance that varies
(i) from 4.9 metres at its western end and 2.2metres at the eastern end of an arc 20.2 metres long,
(ii) then by a distance that varies by 7.3 metres at its western end and by 5.4 metres along a 15.5 metres arc,
(iii) then by 6.8 metres along a 1.2 metres arc situated 7 metres from the perimeter wall of the said gardens,
(iv) then by 12 metres from the boundary of the said gardens along a 5.1 metres arc,
(v) then by 11.6 metres from the boundary of the said gardens along a 1.2 metre length arc,
(vi) then by a distance that varies from a 26.8 metres arc by 5.1 metres due south-east and at least 7 metres from the perimeter wall of the said gardens,
(vii) then 3.4 metres midway along that 26.8 metres arc.
(viii) then by a distance that varies from 5.1 metres due south-east, at least 6.4 metres from the perimeter wall of the gardens to 4.2 metres east-south-eastward, at least 3.4 metres from the perimeter wall of the gardens along the final 10.1 metres length of that 26.8 metres arc.
Pursuant to sub-section 247 (3) of the Act, the Highway Improvements shall each be highway that is maintainable at the public expense for the purposes of the Highways Act 1980.
The order and plan identifying the location of the highway authorised to be stopped up may be inspected free of charge between 11am and 5pm Mondays to Fridays at Westminster City Hall, 64 Victoria Street, London, SW1E 6QP, during a period of six weeks from the date of this notice. Any person aggrieved by the order who desires to question the order’s validity may make an application to the High Court under section 287 of the Town and Country Planning Act 1990 Act within six weeks of the date this notice is first published.
This notice is given by Westminster City Council pursuant to section 252 of the Town and Country Planning Act 1990 on the date 26 August 2026.
Westminster City Council granted permission for the development under part three of the Town and Country Planning Act 1990 on the date 24th May 2022 in response to application reference 19/08460/FULL which was non-materially amended by applications 23/03982/NMA permitted 17 July 2023 and 24/08626/NMA permitted 21 January 2025 and 25/01785/NMA permitted 28 March 2025.
