PUBLIC NOTICE OF INTENTION TO APPROPRIATE AND DISPOSE OF LAND AT BATH QUAYS NORTH

LOCAL GOVERNMENT ACT 1972 SECTION 122
HOUSING AND PLANNING ACT 2016 SECTION 203

This notice relates to land at Bath Quays North Development Site, Avon Street, City Centre, Bath (“the Site”)

NOTICE IS HEREBY GIVEN on behalf of Bath & North East Somerset District Council (“the Council”) that:

1. On 2 April 2019 planning permission was granted by the local planning authority for a comprehensive mixed use redevelopment of the Site pursuant to application reference
18/00058/EREGO3 (“the Planning Consent”) and subsequent applications 20/02787/VAR, 20/04965/ERES & 25/00142/RES.

2. On 12th May 2026 the Council delegated authority to the Director of Economy and Growth (“the Director”) in consultation with others to take all necessary acts to appropriate the Site for planning purposes; and

3. The Director intends to consider a report on the appropriation of the Site for planning purposes in November 2026 to enable redevelopment to be carried out in accordance with the Planning Consent

A plan showing the extent of the Site and a copy of the Planning Consent may be inspected at Bath & North East Somerset Council Offices, One Stop Shop, Lewis House, Manvers Street, Bath BA1 1JG between the hours of 10.00 am and 4.00 pm Monday to Friday.

The benefits of the redevelopment of the Site proceeding include the revitalisation of the Bath Quays North area with new residential properties along with the replacement of out dated parking and the promotion of the economic, social and environmental well being of the area.

In the event that the appropriation proceeds and development is undertaken in accordance with the Planning Consent, private third party rights affecting the Site will be overridden pursuant to section 203 of the Housing and Planning Act 2016. 

Any person who holds the benefit of such a legal right and who suffers a reduction in the value of their property when development is carried out would, at that stage, be entitled to claim statutory compensation from the Council pursuant to section 204 of the 2016 Act.

Anyone who wishes to make representations to the Council in respect of the proposed appropriation of the Site for planning purposes should write to Jonathan Seaman, Development Lead, Keynsham Civic Centre, Market Walk, Keynsham, BS31 1FS to arrive no later than 5:00 pm on Thursday 10th September 2026 and include details of any right or interest they hold which they consider may be affected by the redevelopment. 

Representations received by that date and time will be considered by the Director before a decision on the appropriation is reached.
