Notice is hereby given that SETT Wind Development Ltd, with company registration number 10988810, having its registered office at Lindarets House, Spring Lane, Ringwood, Hampshire, England, BH24 3FH has made an application (the “variation application”) to the Scottish Ministers to vary the consent granted under section 36 of the Electricity Act 1989 (the “section 36 consent”) to construct and operate the Shepherds’ Rig Wind Farm, located approximately 5 kilometres (km) to the east of Carsphairn in Dumfries and Galloway (Central Grid Reference 262319 593591), previously consented on 21 August 2023 by the Scottish Ministers. The proposed variation is subject to Environmental Impact Assessment (EIA). An EIA Report has been produced to accompany the variation application.

The variation application seeks to make the following variations:

• Extending the period for implementation of the consent by three years so that it expires on 21 August 2031;

• Removal of six turbines and associated crane hard standings;

• Increase the maximum blade tip height of the remaining 11 turbines to 220 m, increasing turbine generating capacity to 77 megawatts (MW);

• Increase the size of associated crane hardstandings to accommodate the larger turbines;

• Relocate eight turbines beyond the micrositing allowance of the section 36 consent, but within the same pattern of development;

• Amend part of the track layout to reflect turbine removal and relocation (as outlined above);

• Change to the number and location of required watercourse crossings to accommodate the amended track layout;

• Increase the size of the associated Battery Energy Storage System (BESS), and increase its capacity to 50 MW;

• Relocate the temporary construction compound outside of the approved micrositing allowance;

• Remove the previously proposed permanent anemometer mast; and

• Increase to the period of consent from 30 to 40 years.

A summary of the variation application, a copy of the variation application, a copy of the original section 36 consent and decision letter including the direction under section 57 of the Town and Country Planning (Scotland) Act 1997 which stated that planning permission was deemed to be granted, and the EIA report prepared in relation to the proposed varied development (“the variation application documents”) are available for public inspection in person, free of charge, during normal office hours at:

Any representations on the variation application may be submitted via www.energyconsents.scot, using the relevant Project Name and/or ECU reference number. Please note that you must be in possession of a working email address to submit a representation virtually.

Written representations should be dated, clearly stating the name (in block capitals) and full postal address of those making representations.

All representations should be received not later than 05 October 2026. Scottish Ministers may be able to consider written representations received after this date.

Any subsequent additional information which is submitted by the Company will be subject to further public notice in this manner, and representations to such information will be accepted as per this notice.

Where Scottish Ministers decide to exercise their discretion to do so, they can cause a public inquiry to be held.

Scottish Ministers will determine the application for consent in one of two ways:

• Grant consent, with or without conditions attached; or

• Refuse the proposal.
