DIRECTION MADE UNDER ARTICLE 4(1) TO WHICH SCHEDULE 3 APPLIES


Dudley Metropolitan Borough Council has received an application from Ms Danielle Hunt for prior notification under Schedule 2, Part 11 for the demolition of a building at 39 Churchfield Street, Dudley DY2 8QR.

The building is included on the Dudley Local List of heritage assets and the Council is of the opinion that the demolition would be prejudicial to the proper planning of their area and constitutes a threat to the amenity of their area. In response to this immediate threat the site is now subject to an immediate Article 4(1) Direction withdrawing the permitted development rights comprised within Class B, Part 11 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015.

The Direction is made under Article 4(1) of the said order and in accordance with Schedule 3, paragraph 2, comes into immediate effect on the 29th July 2026 and shall remain in force for six months until the 29th January 2027 and shall then expire
unless it has been confirmed by the local planning authority in accordance with paragraphs 1(9) and 1(10) of Schedule 3 before the end of the six-month period.

Full planning permission is now required for any demolition works on the site. Any demolition works undertaken prior to the granting of planning permission would be unlawful and potentially subject to formal Enforcement Action and / or prosecution by the local planning authority.

A copy of the Direction and a map defining the site to which the Direction relates is displayed alongside this notice or can be inspected at the offices of Dudley Metropolitan Borough Council, The Council House, Priory Road, Dudley, DY1 1HF on weekdays between 9am and 5pm.

To make any representations concerning this Direction you may write to Dudley Council at the above address. Any representation must be made within a period of 30 working days starting from the 29th July 2026.
