Notice is hereby given that updated information, including Environmental Statement addendum documents, has been submitted to the Planning Casework Unit of MHCLG relating to the above planning application.

Background information

This called-in application was granted permission by the then Housing and Planning Minister on 29 July 2021. This decision was quashed by the High Court on 8 April 2022. The Holocaust Memorial Act 2026 came into effect on 22 March 2026.

The application will now be redetermined. Following the reshuffle on 20 July 2026, the decision-making minister on this case has changed and will be confirmed in due course.

Publicisation of Environmental Statement and associated material

As part of the preparation for redetermination, the Planning Casework Unit has received documents from the applicant, including updates to the Environmental Statement in addendum documents. The availability of further information in relation to the original Environmental Statement is publicised here in accordance with Regulation 25(3) of the Town and Country Planning (Environmental Impact Assessment) Regulations 2017.

The applicant has also provided new and updated plans and documents to be considered as part of the redetermination, including a Security Note with accompanying security consultee responses.

Copies of the Environmental Statement addendum documents (which are identified at the above link) are also available for inspection at: Westminster City Council, City Hall, 64 Victoria Street London SW1E 6QP. A copy of this information may be inspected by members of the public at all reasonable hours. Anyone wishing to inspect these should contact Emma Cox (planningappeals@westminster.gov.uk) to make arrangements to view the documents.

A limited number of copies will be available which may be obtained while stocks last. The documents will be available to view until at least 30 August 2026.

Anyone wishing to make representations about the Environmental Statement addendum documents should make them in writing to the decision-making minister , via the Planning Casework Unit at PCC@communities.gov.uk. Comments should be submitted by 30 August 2026.

Comments on the updated and additional planning documents, should also be sent to PCC@communities.gov.uk. It would be helpful if they could be made to the same timescale, however, representations on the case may be made at any point before the final decision issues.

Representations via email are preferred; however, they can also be made by post to Planning Casework Unit, 3 rd Floor, Fry Building, 2 Marsham Street, Westminster, London SW1P 4DF.

Next steps

No decision has yet been taken on whether the inquiry will be reopened, or the redetermination carried out on the papers.

Following this consultation, as part of the process under Rule 19 of The Town and Country Planning (Inquiries Procedure) (England) Rules 2000, a letter will be sent to those who were entitled to appear at the Inquiry under Rule 11(1) of the Rules and did so appear, as well as a number of additional interested parties. These include the Corporate Officers of the Houses of Commons and Lords. These parties will be invited to make representations on any matters of fact and policy which may have changed since the original decision. They will also be asked for their views on the redetermination method, prior to a decision being taken on this.

The timetable for the final decision will depend on the method of redetermination. If redetermination proceeds on the papers, the date will be set as the same time as notification of the redetermination procedure. If the inquiry is reopened, a decision date will be set when the Inspector's Report is submitted to the Department.

Special handling arrangements are in place for this case to maintain separation between the applicant side (the Secretary of State and supporting officials), and the decision-making side (the decision-making minister, and supporting officials).
