What is planned?

TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT ORDER 2015) AS AMENDED

IMMEDIATE DIRECTION MADE UNDER ARTICLE 4(1) TO WHICH ARTICLE 6 APPLIES

NOTICE IS GIVEN that SWALE BOROUGH COUNCIL made an Immediate Direction on 21st July 2026 under Article 4(1) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended)

The Immediate Direction relates to development consisting of:-

SCHEDULE

(i) In respect of the Land, the following permitted development right within Part 3 of Schedule 2 of the Order is withdrawn and planning permission will be required: Development consisting of a change of use of a building and any land within its curtilage from a use falling within Class C3 (Dwelling Houses) of the Schedule of the Town and Country Planning (Use Classes) Order 1987 (as amended) to a use falling within Class C4 (Houses in Multiple Occupation) of that Schedule, being development comprised within Class L (b) of Part 3
of Schedule 2 of the Order and not being development comprised within any other Class.

The Immediate Direction removes permitted development rights for this type of development from the date it was made namely 21st July 2026, and Planning Permission will therefore be required for the development named within the Schedule after this date.

For any property within the Swale Borough Council Designated Area shown edged red on the plan appended at Appendix A (“the Land”) and attached to the Direction.

Representations may be made concerning the Article 4 Direction between 21st July 2026 and 4th September 2026 inclusive. If you wish to make representations you may do so by email to hmoarticle4@swale.gov.uk or by post to the Head of Place, Swale Borough Council, Swale House, East Street, Sittingbourne, ME10 3HT. Any representations must be received by 5pm on 4th September 2026.

The Immediate Direction comes into force today being 21st July 2026.
