NOTICE OF INTENDED APPROPRIATION OF PUBLIC OPEN SPACE

NOTICE is hereby given pursuant to Section 122 (1) of the Local Government Act 1972 that North Yorkshire Council proposes to appropriate the land described below.

The land is currently held as Public Open Space. The Council proposes to appropriate the land for highway purposes, specifically to facilitate the construction of a foot bridge and cycle track and footpath which will be adopted and maintained as part of the public highway network. Although the land will continue to be accessible to the public, it’s use will change from open space to dedicated bridge and cycle route.

Description of the Land:

Location: land lying to the east of Pornic Avenue and west of Hillcrest Avenue, Scalby, Scarborough shaded pink on the plan below.

In accordance with the provisions of Section 122 (1) of the Local Government Act 1972 the Council will consider any objections to the proposed disposal of the land which are to be received within 14 days of the date of the first publication of this notice and which are addressed to:

Bryan Walker, Principal Estates Manager, North Yorkshire Council, Town Hall, St Nicholas Street, Scarborough YO11 2HG or by email to estatesteam@northyorks.gov.uk

Any objections or representations made within the time set out in this notice will be considered by the Council before a decision is made.
