St Tudy - River Camel Catchment Area - Local Development Order- Upgrading septic tanks and small sewage treatment plants within River Camel Special Area of Conservation - PA26/01068 

The Council has proposed the making of a Local Development Order (LDO) to enable septic tanks to be replaced with more efficient treatment systems within the River Camel Catchment Area. This approach aims to improve water quality, reduce costs and planning burdens. 

The proposed LDO is intended to provide a permissive mechanism to support upgrades, not to mandate them. The purpose of the LDO would be to allow homeowners to upgrade existing septic tanks or package treatment plants without the need to apply for planning permission, where certain criteria are met. Importantly, it would not impose any requirement on homeowners to undertake upgrades. 

The draft Order is accompanied by an Environmental Impact Assessment Screening Opinion and Habitats Regulations Assessment, as well as other supporting documents. These include the Statement of Reasons, which sets out the Council's justification for seeking the Order. You can track the application, view the documents, plans and make a comment on the proposal within 35 days of the date on this notice via the website https://planning.cornwall.gov.uk/online-applications. Only those comments relevant to material planning considerations will be taken into account as part of an application's determination. Any representations received will be open to public inspection.

The Local Government (Access to Information) Act 1985 requires that such correspondence must be made available for inspection either by Councillors or members of the public (which may include the Press). Please also be aware that in the event of an appeal against the decision, any representations made in connection with the application will be sent to the Secretary of State and the appellant.
