Town & Country Planning Act 1990 - Notice Of The Stopping Up Of Highways, (London Borough Of Enfield) (Napier Road And South Street) (No.3) Order 2026

The Mayor and Burgesses Of The London Borough Of Enfield (the "Council") hereby give notice that they have made an Order under Section 247 of the Town & Country Planning Act 1990 (as amended by Schedule 22 to the Greater London Authority Act 1999) ("the Act") to authorise the stopping up of those parts of the highway described in the First Schedule below and shown on the Order Plan (Drawing No. SCP/260255/SK02 dated 23/02/2026) ("the Plan") as the hatched area identified in the Plan key as "Highway to be stopped up".

1. IF THE ORDER IS MADE, the stopping up will be authorised to enable development to be carried out in accordance with the planning permission granted under Part III of the Act by the London Borough of Enfield on 20 June 2017 under reference 15/02039/OUT

2. COPIES OF THE ORDER AND RELEVANT PLAN MAY BE INSPECTED free of charge between the hours of 9:00am and 5:00pm on Monday to Friday (excluding bank and public holidays) for a period of 28 days commencing on 27th May 2026 at: Town Library, 66 Church Street, EN2 6AX

3. A copy may also be requested by contacting: TransportClimateandPlace@enfield.gov.uk, and quoting reference: Alma-SUO2026/03.

4. Any person aggrieved by the Order and desiring to question its validity, or any provision contained in the Order, on the ground that it is not within the powers of the Act or that any procedural requirement of the Act or any regulation made under the Act has not been complied with in relation to the making of the Order may, within six weeks following the date of this Notice apply to the High Court for the suspension or quashing of the Order or any provision contained in the Order.

FIRST SCHEDULE

Description Of Highway To Be Stopped Up

The highway land to be stopped up is shown on the Order Plan (Drawing No. SCP/260255/SK02 dated 23/02/2026) as the hatched area identified in the Plan key as "Highway to be stopped up" ("the Stopping Up Land").

Northern Area: Existing footway adjacent the northern side of Napier Road on the section of carriageway 35m west of the Napier Road / Curzon Avenue junction to 5m west of the Napier Road / Grouse Way junction. Heading west, area includes the existing Napier Road carriageway up to the garages on the western end of the road, including footways adjacent both sides of the carriageway, and existing refuse and substation access.

Southern Area: Existing circular access road and parking off South Street, and existing footway on southern side of existing retail development enclosed by South Street, Grouse Way and Scotland Green Road. Area includes existing carriageway and off-street parking at the Scotland Green Road / access junction to southern side of retail development, running to a point 15m east of the junction; and footway adjacent the eastern side of Scotland Green Road up to 5m north of the Scotland Green Road / access junction to southern side of retail development.

The area of highway quoted in the table below has been rounded to the nearest square metre. The Plan should be referred to for exact locations.
