DISPOSAL OF LISTED LAND AND BUILDING 

HOLYWELL GREEN UNITED REFORMED CHURCH AND

GRAVEYARD, STAINLAND ROAD, HALIFAX, HX4 9HJ (“THE PROPERTY”)

NOTICE is hereby given that on 22nd April 2026 the owner of the Property notified the Council pursuant to section 95(2) of the Localism Act 2011 (“the Act”) that it intends to make a Relevant Disposal (as defined by the Act) of the Property. The Property has been listed as an asset of community value on the Council’s Register of Assets of Community Value since 4th April 2024.

Any eligible community interest group (as defined in the Act and the Assets of Community Value (England) Regulations 2012 (“the Regulations”)) may now express an interest in being treated as a potential bidder for the Property. Any intention to bid must be made in writing to the Council before the end of the interim moratorium period, which expires on 3rd June 2026. Any intention to bid received after 3rd June 2026 will not be accepted by the Council.

If any eligible intention to bid is received by the Council during the interim moratorium period the Council will notify the owner in writing that such group should be seen as a potential bidder. The community interest group then has until the end of the full moratorium period (which expires on 22nd October 2026) to prepare and submit a bid for the Property to the owner.

During the interim moratorium period (or during the full moratorium period where a community interest group has made a written request to be treated as a bidder before the expiry of the interim moratorium period) the owner may not dispose of the Property other than to a community interest group (or where the disposal falls within an exemption identified in the Act or Regulations).

If no eligible intention to bid is received during the interim moratorium period or no sale to a community interest group is agreed during the initial moratorium period or full moratorium period the owner may dispose of the Property as it wishes during a protected period expiring on 22nd October 2027.
