MAE GWEINIDOGION CYMRU wedi gwneud Gorchymyn o dan adran 247 o Ddeddf Cynllunio Gwlad a Thref 1990 (“Deddf 1990”) i awdurdodi cau’r darn o briffordd a ddisgrifir yn Atodlen 1 i’r Hysbysiad hwn ac i ddarparu ar gyfer y darn o briffordd newydd a ddisgrifir yn Atodlen 2 i’r Hysbysiad hwn. Nid awdurdodir cau’r briffordd ond er mwyn gwneud y datblygiad yn unol â’r caniatâd cynllunio a roddwyd o dan Ran 3 o Ddeddf 1990 gan Gyngor Bwrdeistref Sirol Caerffili ar 13 Hydref 2023 o dan y cyfeirnod 23/0452/LA VERSION 4 ac a ddisgrifir yn Atodlen 3 i’r Hysbysiad hwn.

Mae’r Gorchymyn yn gwneud darpariaeth ar gyfer cadw hawliau ymgymerwyr statudol ar gyfer unrhyw gyfarpar o dan y briffordd, ynddi, arni, drosti, ar ei hyd neu ar ei thraws.

Bydd y Gorchymyn yn peidio â chael effaith os daw’r caniatâd cynllunio mewn cysylltiad â’r datblygiad i ben neu os caiff ei ddirymu.

Gellir edrych ar gopïau o’r Gorchymyn a’r plan a adneuwyd yn rhad ac am ddim yn ystod oriau swyddfa arferol yn Swyddfeydd Cyngor Bwrdeistref Sirol Caerffili, Tyˆ Penallta, Parc Tredomen, Ystrad Mynach, Hengoed, CF82 7PG, neu gellir eu cael yn rhad ac am ddim o’r cyfeiriad isod drwy ddyfynnu’r cyfeirnod qA2374005.

Caiff unrhyw berson a dramgwyddir gan y Gorchymyn, ar y sail:

a. nad yw o fewn pwerau Deddf 1990; neu

b. na chydymffurfiwyd ag un o ofynion gweithdrefnol Deddf 1990; o fewn 6 wythnos i 7 Mai 2026, wneud cais i’r Uchel Lys at y diben hwnnw.

Darn o droetffordd sy’n dechrau ym Mryncelyn ac yn ymestyn hyd at gyrion Ysgol Fabanod Llanfabon ac yn ymuno â’r droetffordd bresennol sy’n arwain at Ashgrove Terrace y mae ei hyd yn 100 metr a’i led yn 2 fetr, a ddangosir â dotwaith ar y plan a adneuwyd ac a farciwyd fel cyfeirnod B.

TOWN AND COUNTRY PLANNING ACT 1990
NOTICE OF THE STOPPING UP OF HIGHWAYS (LLANFABON INFANT SCHOOL, BRYNCELYN, NELSON, TREHARRIS CF46 6HL) ORDER 2026

THE WELSH MINISTERS have made an Order under section 247 of the Town and Country Planning Act 1990 (“the 1990 Act”) to authorise the stopping up of the length of highway described in Schedule 1 to this Notice and to provide for the length of new highway described in Schedule 2 to this Notice. The stopping up will be authorised only in order to enable the development to be carried out in accordance with planning permission granted under Part 3 of the 1990 Act by Caerphilly County Borough Council on 13 October 2023 with reference 23/0452/LA VERSION 4 and described in Schedule 3 to this Notice.

The Order makes provision for the preservation of rights of statutory undertakers for any apparatus under, in, on, over, along or across the highway.

The Order ceases to have effect if planning permission in respect of the development expires or is revoked.

Copies of the Order and the deposited plan may be inspected free of charge during normal office hours at Caerphilly County Borough Council, Ty Penallta, Parc Tredomen, Ystrad Mynach, Hengoed, CF82 7PG or may be obtained free of charge from the address below quoting reference qA2374005.

If a person is aggrieved by the Order, on the grounds that:

a. it is not within the powers of the 1990 Act; or

b. a procedural requirement of the 1990 Act has not been complied with; that person may, within 6 weeks of 7 May 2026 make an application for the purpose to the High Court.

Length of highway to be stopped up
An irregular shaped length of highway being part of the entrance and carpark of Llanfabon Infant School having a total area of 470 square metres, shown by zebra hatching on the deposited plan and marked as reference A.

SCHEDULE 2
Length of highway to be provided
A length of footway beginning at Bryncelyn and extends to the periphery of Llanfabon Infant school and joins onto the existing footway that leads to Ashgrove Terrace having a length of 100 metres and a width of 2 metres, shown by stipple hatching on the deposited plan and marked as reference B.

SCHEDULE 3
The Development
Erect two storey extension with single storey link and freestanding single storey childcare unit to amalgamate Llanfabon Infant and Llancaeach Junior Schools to form a new Primary School facility.
