NOTICE OF CONFIRMATION OF IMMEDIATE ARTICLE 4 DIRECTION
NOTICE IS GIVEN that the Council of the Borough of South Tyneside (“Council”) have, on 11 March 2026, confirmed the Article 4 Direction (“Direction”) that was made on 26 November 2025 and which took effect on 3 December 2025 under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (“Order”).
The Direction relates to development consisting of a change of use of a building from a use falling within Class C3 (dwellinghouses) of Schedule 1 to the Town and Country Planning (Use Classes) Order 1987 (as amended) (“UCO”) to a use falling within Class C4 (houses in multiple occupation) of that Schedule of the UCO, being development comprised within
Class L of Part 3 of Schedule 2 to the Order, and not being development comprised within any other Class.
The Direction relates to all land within the administrative boundaries of the Borough of South Tyneside, except for the land presently subject to the ‘Lawe Top and surrounding area HMO Article 4 Direction’, as that term is defined in the Order.
The Direction removes permitted development rights for the above-mentioned development, such that planning permission is required for any change in the use of a building within the above-mentioned area, from a use falling within Class C3 (dwellinghouses) to a use falling within Class C4 (houses in multiple occupation) of Schedule 1 to the UCO.

The Direction took effect on 3 December 2025 and now remains in force in perpetuity.
