Land to North of Stretton Road, Morton, Alfreton, DE55 6HA
JBM Solar Projects 28 Ltd (the Appellant) has lodged a planning appeal regarding the above Site following the refusal of full planning permission by North East Derbyshire District Council on 22nd May 2025 for:
“The installation and operation of a renewable energy generating station comprising of ground-mounted photovoltaic solar arrays together with inverter/transformer units, BESS units, control house, substation, onsite grid connection equipment, storage containers, site access, access gates, internal access tracks, security measures, other ancillary infrastructure, and landscaping and biodiversity enhancements (Major Development/Affecting Public Right of Way) (Amended Plans)”

The Appellant has invited the Inspector to determine the Appeal on the basis of an amended Site Layout (Typical Fixed Design, Rev L, dated 4 th August 2025) and Landscape Masterplan (P25-1599_EN_001B). The proposed changes are as follows:
• Amendment 1 – Updates to reflect the alignment of historic lost hedgerows to encapsulate alignment with historic (Tithe) mapping.
• Amendment 2 – Extending the previously proposed permissive footpath route looping around the land parcels to the east of Evershill Lane / PRoW to create a looped walk.
• Amendment 3 – Addition of information boards incorporated along the permissive footpath route.
• Amendment 4 – All of the hybrid inverter containers have been moved outside of the updated Risk of Surface Water Flooding (“RoSWF”) extents.
• Amendment 5 – Additional orchard tree planting in the southern extent of Field 10.
