What is planned?

Notice of Confirmation of Rail Crossing Extinguishment Order, Highways Act 1980 118A, & Wildlife & Countryside Act 1981, The North Yorkshire Council Public Footpath No. 35.59/5, South Milford Rail Crossing, Extinguishment Order 2023.

On 14/11/25, the Planning Inspectorate confirmed this Order, made under Section 118A of the Highways Act 1980. The effect of the Order as confirmed is to extinguish the Public Footpath:- From GR SE5030 3183 & runs eastwards via a railway level crossing to GR SE5127 3172 then generally south via railway level crossing & continues southwards to GR SE5119 3153 where it joins Common Lane. A copy of the order as confirmed & the Map contained in it has been placed & may be seen free of charge during normal office hours at Sherburn & Villages Community Library, Finkle Hill, Sherburn-in-Elmet, North Yorkshire until 22/01/26. Copies of the Order & Map may be purchased from Countryside Access Service, North Yorkshire Council, County Hall, Northallerton, North Yorkshire, DL7 8AD (tel: 0300 131 2131) at a cost of £2, or can be downloaded free from our website www.northyorks.gov.uk/pathnotices. The Order comes into force  as from 14/11/25, but if any person aggrieved by the Order desires to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under it has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within 6 weeks from 11/12/25, make an application to the High Court.
