NOTICE OF PROPOSAL TO VARY THE LATE NIGHT LEVY IN THE LONDON BOROUGH OF SOUTHWARK

The Late Night Levy (Expenses, Exemptions and Reductions) Regulations 2012

The London Borough of Southwark is hereby giving notice of its proposal to vary the late night levy that was introduced on 1 September 2019 to include premises licensed to provide the provision of late night refreshment between midnight and 6am (00:00 to 06:00 hours) in the borough of Southwark.

A Summary of the proposed Variation is:

1. The Council’s proposed variation of the late night levy will be introduced on 01 April 2026.

2. The Council’s proposed late night supply period will begin at 00:00hrs and end at 06:00hrs.

3. The Council propose the following permitted categories of premises will be exempt from paying the levy as defined in the Late Night Levy (Expenses, Exemptions and Reductions) Regulations 2012:

a) Premises with overnight accommodation, where the provision of late-night refreshment can only be supplied to persons staying at the premises for consumption on the premises.
b) Theatres and cinemas.
c) Bingo Halls.
d) Community Amateur Sports Clubs.
e) Community premises.

4. The Council proposes that a reduction of 30% be granted to premises that are within a defined Business Improvement District (BID) as defined in regulations 5 (1) (a) and 5 (4) of the above Expenses, Exemptions and Reductions Regulations 2012.

5. The Council is not proposing to apply any other exemptions or reductions.

6. The Council will allow Licence holders to make an application to vary their Licence under sections 41A or 86A (minor variation) of the Licensing Act 2003. There will be no fee for such a valid application provided it is received by the Council within the 2-month period directly following the date of a formal decision notice to vary the Levy. This applies only to the reduction of licensed hours for the provision of late-night refreshment so they do not fall within the operational hours of the Levy (00:00 to 06:00 hours).

The Council would like to hear your views on its proposal to vary the Late Night Levy within the London Borough of Southwark. Please note that there is a 4 week consultation period therefore the Council must receive your views from 24 November 2025 and no later than midnight on 22 December 2025, otherwise we will not be able to consider them.
