NOTICE UNDER ARTICLE 13 OF APPLICATION FOR PLANNING PERMISSION

ENVIRONMENT AGENCY ANNOUNCEMENT OF INTENTION NOT TO PREPARE AN ENVIRONMENTAL STATEMENT

Ford Green Brook (Banksy Brook), Stoke on Trent, Restoration Works

The Environment Agency gives notice that its authorised delivery partner, Staffordshire Wildlife Trust, proposes to carry out improvement works on the Ford Green Brook and its floodplain, NGR upstream reference SJ 89675 50134 and downstream reference SJ 87955 53353, a distance of 4.8 kilometres. Restoration Works are due to be carried out between 15th June and 30th September 2026, weather permitting and will last for a several weeks.

The project will involve a number of interventions targeted towards improving habitats and biodiversity, such as:

1.Addition of large wood material into the brook to create structure within the channel and diversify the water flow. All material will be secured in place, providing opportunities for a range of water invertebrates and encouraging natural processes.

2.Wetland creation in the floodplain valuable for filtering land runoff and resilience by providing a greater range of freshwater habitats.

3.Changing the channel profile to promote natural processes and establish a greater connection to the floodplain.

4.Creation of valley cliffs as bird breeding habitat and encourage meanders when water is out of channel. These interventions have been flood modelled, are subject to an Environment Agency Impoundment Licence and Ordinary Watercourse Consent from Stoke-on-Trent City Council. The interventions should not change access to the site after completion and do not pose an increased risk to nearby residents or businesses. The Environment Agency considers that the improvement works are not likely to have significant effects on the environment due to the method and timing of the works and does not intend to prepare an environmental statement in respect of them.

Any person wishing to make representations in relation to the likely environmental effects of the proposed improvement works should do so, in writing, to the address specified below, within 30 days of the date of publication of this notice.

Statement of owners’ rights: The grant of planning permission does not affect owners’ rights to retain or dispose of their property, unless there is some provision to the contrary in an agreement or lease. Statement of agricultural tenants’ rights: The grant of planning permission for non-agricultural development may affect agricultural tenants’ security of tenure. This notice is for publication in a local newspaper. ‘Owner’ means a person having a freehold interest or a leasehold interest the unexpired term of which is not less than seven years. ‘Tenant’ means a tenant of an agricultural holding any part of which is comprised in the land.
