NOTICE OF CONFIRMATION

TOWN AND COUNTRY PLANNING ACT 1990
KIRKLEES COUNCIL
(KIRKBURTON 259 (PART)) STOPPING UP ORDER 2025
On 07 November 2025 Kirklees Council confirmed the above order.
The effect of the order is to stop up part of Kirkburton 259 having a width of 1.2 metres shown on the order plan by a bold solid line commencing at its junction with Hermitage Park at grid reference SE 1917 1472 (Point A on the order plan) and leading south-easterly for some 158 metres to grid reference SE 1933 1468 (Point B on the order plan).
New paths will be created, as described below:
(a) A public footpath with a width of 2 metres shown on the order plan by a bold dashed line commencing at grid reference SE 1930 1475 (Point C on the order plan) and leading southsouth-easterly for some 90 metres to and across Kirkburton 85 then south-easterly then turns south-westerly then northwesterly for some 351 metres to grid reference SE 1922 1451 (Point D on the order plan).
(b) A public footpath with a width of 2 metres shown on the order plan by a bold dashed line commencing at grid reference SE 1922 1452 (Point E on the order plan) and leading northnorth-westerly for some 127 metres to join Kirkburton 85 at grid reference SE 1918 1463 (Point F on the order plan).
(c) A public footpath with a width of 2 metres shown on the order plan by a bold dashed line commencing at grid reference SE 1919 1462 (Point G on the order plan) and leading southeasterly for some 57 metres to grid reference SE 1922 1458 (Point H on the order plan).
(d) A public footpath with a width of 2 metres shown on the order plan by a bold dashed line commencing at grid reference SE 1932 1450 (Point I on the order plan) and leading north-northwesterly for some 10 metres to grid reference SE 1931 1451 (Point J on the order plan).
(e) A public footpath with a width of 2 metres shown on the order plan by a bold dashed line commencing at grid reference SE 1931 1469 (Point K on the order plan and leading east-northeasterly for some 6 metres to grid reference SE 1932 1469 (Point L on the order plan).

The Order comes into force on the date on which Kirklees Council certify that the terms of Article 2 of the Order have been complied with but if any person aggrieved by the order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the Order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to the Act.
