Network Rail (Stalybridge to Diggle (Saddleworth) Enhancements) Order

NOTICE OF APPLICATION FOR AN ORDER AND FOR LISTED BUILDING CONSENT

Network Rail Infrastructure Limited (“Network Rail”) of Waterloo General Office, London SE1 8SW is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for the above-mentioned Order under sections 1 and 5 of that Act.

The Order would authorise Network Rail to construct, operate and maintain works on the Transpennine Line between Stalybridge and Diggle (Saddleworth) including works for the electrification of the railway between Stalybridge and Diggle (Saddleworth), for the purposes of increasing capacity and improving journey time and performance reliability of railway services on the Transpennine Line both between Stalybridge and Diggle (Saddleworth) and between Manchester, Leeds and York.

The Order would authorise works to upgrade the operation of the existing railway between Stalybridge and Diggle (Saddleworth), including the construction of a new station at Mossley, railway electrification works and bridge reconstruction works. The Order also confers powers to close and replace existing level crossings on the railway between Stalybridge and Diggle (Saddleworth) and powers in connection with the construction and operation of the railway.

The Order makes provision for Network Rail to compulsorily acquire land, the subsoil and airspace of land, interests in land, including the imposition of restrictive covenants, and to use land temporarily for the purposes of the works to be authorised by the Order and the provision of railway infrastructure on the railway between Stalybridge and Diggle (Saddleworth) for which Network Rail has permitted development rights.

The Order makes provision for the disapplication of legislative provisions. The Order also makes provision regarding the application of local railway enactments.

The Order includes provisions to execute street works, temporarily and permanently stop up footpaths and highways, alter the layout of streets, provide access to works, make traffic regulations and provisions relating to streets.

The Order makes provision to discharge water, to carry out protective works to buildings, roads and apparatus of a statutory undertaker on land within the limits of the Order, to survey and investigate land and to temporarily close and carry out works in the Huddersfield Narrow Canal.

The Order also provides for powers relating to the operation and use of the railway, a defence to proceedings in respect of statutory nuisance, the felling or lopping of trees overhanging the proposed works and the prevention of obstruction of the construction of works and ancillary provisions.

The application is not to be made subject to an Environmental Impact Assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.

Listed building consents are also required for the purposes of proposals included in the application for the Order.

The following listed building consent applications are being made to Tameside Metropolitan Borough Council:

1. An application for listed building consent in respect of the listed Heyrod Hall Overbridge (MVL3/7). The proposed works include the removal and reconstruction of the bridge deck, and partial reconstruction of the abutments at Heyrod Hall Overbridge (MVL3/7).

2. An application for listed building consent in respect of the listed Springbank Lane Footbridge (MVL3/8). The proposed works include the replacement of the existing copers, minor repair works and the attachment of parallel flange channel to Springbank Lane Footbridge (MVL3/8).

3. An application for listed building consent in respect of the listed Roughown Road Overbridge (MVL3/17). The proposed works include the replacement of copers and attachment of new single line electrification equipment to Roughown Road Overbridge (MVL3/17).

The following listed building consent application is being made to Tameside Metropolitan Borough Council and Oldham Metropolitan Borough Council:

4. An application for listed building consent in respect of the listed Wright’s Mill Overbridge (MVL3/20). The proposed works include the removal and reconstruction of the bridge deck, and partial reconstruction of the abutments at Wright’s Mill Overbridge (MVL3/20).

The following listed building consent applications are being made to Oldham Metropolitan Borough Council:

5. An application for listed building consent in respect of the listed Wright’s Overbridge (MVL3/23). The proposed works comprise the demolition of Wright’s Overbridge (MVL3/23).

6. An application for listed building consent in respect of the listed Royal George Underbridge (MVL3/25). The proposed works include the removal and reconstruction of the bridge deck, and partial reconstruction of the abutments at Royal George Underbridge (MVL3/25).

7. An application for listed building consent in respect of the listed Shaw Hall Bank Road Footway (MVL3/26). The proposed works include bridge deck strengthening of Shaw Hall Bank Road Footway (MVL3/26).

8. An application for listed building consent in respect of the listed Oldham Road Overbridge (MVL3/28). The proposed works include the removal and reconstruction of the bridge deck, and partial reconstruction of the abutments at Oldham Road Overbridge (MVL3/28), and construction of an attached footbridge.

9. An application for listed building consent in respect of the listed Wickens Underbridge (MVL3/29). The proposed works include bridge deck strengthening and replacement of handrails to Wickens Underbridge (MVL3/29).

10. An application for listed building consent in respect of the listed Uppermill Viaduct (MVL3/31). The proposed works include the installation of overhead line equipment portals along Uppermill Viaduct (MVL3/31).

Under section 12(3A) of the Planning (Listed Buildings and Conservation Areas) Act 1990 the listed building consent applications will be referred to the Secretary of State for Housing, Communities and Local Government for determination.

A copy of the application, and all of the plans and other documents submitted with it, and of the listed building consent application and all plans and documents submitted with it may be inspected free of charge from 7 November 2025 until 19 December 2025 at the places and at the times set out in the Schedule to this notice.

An objection or other representation about the proposals in the Transport and Works Act Order application and / or the proposals in the applications for Listed Building Consent MUST

(i) be received by the relevant Secretary of State on or before 19 December 2025,

(ii) be made in writing (whether sent by post or e-mail),

(iii) state the grounds of the objection or other representation,

(iv) indicate who is making the objection or other representation, and

(v) give an address to which correspondence relating to the objection or other representation may be sent. (If you are sending your objection or other representation by email, please provide a postal address and state “Network Rail Stalybridge to Diggle Order” in the subject of the email).

The relevant Secretary of State may make complete copies of the objections and other representations public, including any personal information contained in them, and will copy them to the applicant for the Order.
