NOTICE OF MAKING A LOCAL DEVELOPMENT ORDER UNDER

ARTICLE 38 OF THE ORDER

1. NOTICE IS HEREBY GIVEN that Blackburn with Darwen Borough Council (“the Council”) being the appropriate local planning authority proposes to introduce a local development order (“the Order”) under Article 38 of the Town and Country Planning (Development Management Procedure) (England) Order 2015. The details of the Order are set out in the FIRST SCHEDULE of this notice.

2. The effect of the Order is that once it comes into force, development of the type specified in the FIRST SCHEDULE of this Notice can be carried out within the areas specified in the SECOND SCHEDULE of this Notice without the need to apply for planning permission under Part III of the Town and Country Planning Act 1990 (as amended).

3. A copy of the draft local development order and the statement of reasons, can be seen at:

a. ground floor reception of Blackburn Town Hall, King William Street, Blackburn, BB1 7DY on weekdays between 08.45 and 17:00

b. ground floor reception of Darwen Town Hall, Croft Street, Darwen, BB3 2RN on weekdays between 08.45 and 17:00

c. Blackburn Central Library, Town Hall Street, BB2 1AG

d. Cherry Tree Library, Cherry Tree Lane, Blackburn, BB2 5NX

e. Darwen Library, Knott Street, Darwen, BB3 3BU

f. Mill Hill Library, New Chapel Street, Blackburn, BB2 4DT

g. Roman Road Library, Fishmoor Drive, Blackburn, BB2 3UY

h. Barlow Institute, 261 Bolton Road, Turton, BL7 0AP

5. Representations concerning the proposed development order can be made between 9am on 13 October and ending 5pm on 10 November 2025. These representations will be considered by the Council in deciding whether to confirm the Order.

7. The local development order shall not come into force until it has been confirmed by the Council. If the Order is confirmed, notice of the decision will be given of the confirmation of the Order.

FIRST SCHEDULE

The installation of electric vehicle charge points on the front elevations of residential properties that do not have street frontage and where a cross-pavement cable channel has been, or will be, installed under a separate process.

SECOND SCHEDULE

All residential properties within Blackburn with Darwen Borough Council to which this Order relates:

All residential properties within Blackburn with Darwen excluding Listed Buildings, properties within Conservation Areas, properties where highway safety or site-specific physical constraints restrict the safe installation of the charge point or installation of a cross-pavement cable channel (to be confirmed by the Highways Authority at the application process).

Any written comments you make can be inspected by the public under the provisions of the Local Government (Access to Information) Act 1985 and therefore should not contain any remarks which might be regarded as offensive or libellous. It is not necessary to sign letters sent to the Planning Department, however, comments with no name and address will be treated as anonymous and will not be taken into consideration.
