UDNY GREEN CONSERVATION AREA
Notice is hereby given that Aberdeenshire Council have cancelled the existing Conservation Area at Udny Green (designated 12 June 1984) and have simultaneously re-designated it for the purpose of Section 61 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 with amendments to the boundary as described below:
The original Conservation Area as designated on 12 June 1984 has been amended to exclude
3 Hawthorn Gardens
5 Hawthorn Gardens
A plan of the Udny Green Conservation Area showing the amended boundary together with a full street index is available for public inspection from Monday to Friday between 9.00 am and 5.00 pm at Formartine House, Union Street, Ellon.
Subject to the provisions of Section 67 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 no building in a Conservation Area may be demolished without the consent of the Planning Authority. Subject to the provisions of Sections 172 and 173 of the Town and Country Planning (Scotland) Act 1997 anyone proposing to do work on trees in a Conservation Area is required to give the Planning Authority six weeks’ notice of their intentions before the work is carried out.
An Article 4 Direction which brings development that would be deemed as Permitted Development under the Town and Country Planning (General Permitted Development) (Scotland) Order 1992, as amended (the 1992 order), within planning control has been approved by Scottish Ministers for classes.
Part 2
Class 7 – The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure.
Part 10
Class 28 - The carrying out of any works for the purposes of inspecting, repairing or renewing any sewer, main, pipe, cable or other apparatus, including breaking open any land for that purpose.
Part 12
Class 30 - The erection or construction and the maintenance, improvement or other alteration by a local authority of -
(a) any building, works or equipment not exceeding 4 metres in height or 200 cubic metres in capacity on land belonging to or maintained by them, being building, works or equipment required for the purposes of any function exercised by them on that land otherwise than as statutory undertakers;
(b) street furniture required in connection with the operation of any public service administered by them.
Class 31 - The carrying out of works by a roads authority.
Class 33 - The carrying out of works, within their own district, by a local authority.
Part 13
Class 38 - Water undertakings.
Class 39 - Development by a public gas transporter.
Class 40 - Electricity undertakings.
Class 43 - Universal Service Providers.
The immediate effect of such a designation is that the permitted development rights granted by Article 3 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 for the aforementioned classes shall not apply within the Udny Green Conservation Area.
