NOTICE OF CONFIRMATION

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER

TOWN AND COUNTRY PLANNING ACT 1990, SECTION 257

WILDLIFE COUNTRYSIDE ACT 1981, SECTION 53A(2)

The Borough of Blackburn with Darwen (Footpaths 185 (part) and 226 (part) (Darwen) Public Path Diversion Order 2023

On 9th September 2025 the Secretary of State for Environment, Food and Rural Affairs confirmed the above order with modifications.

The effect of the order as confirmed is to divert the public footpaths as described in Schedule 1 to this notice onto the route described in Schedule 2 and as shown on the Order Map. In the interests of the public, it is expedient that the line of the path be diverted.

A copy of the confirmed order and the order map may be examined at the public notice boards outside Blackburn Town Hall and Darwen Town Hall free of charge. Copies of the order may be purchased at the price of 50p, please make a request to Public.RightofWay@Blackburn.gov.uk

The order comes into force on 9th October 2025, but if a person aggrieved by the order desires to question its validity, or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act, or of any regulation made under the Act has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph (7) (8) of Schedule 14 of that Act.

SCHEDULE 1 – LINE OF EXISTING ROUTE

Footpath 185 Darwen

From Point A (SD 72044 20697) to Point C (SD 72070 20680) to Cuckoldman’s at Point D (SD 72118 20650) then in a general southerly direction via Point E (SD 72118 20612), approximate length 124 metres.

Footpath 226 Darwen

From Point B (SD 72054 20721) to Cuckoldman’s at Point C (SD 72070 20680), approximate length 35 metres.

SCHEDULE 2 – LINE OF DIVERSIONARY ROUTE

Footpath 185 Darwen

From Point A (SD 72044 20697), then in a south south westerly direction to Point F (SD 72035 20657), then in a general south easterly direction via Point E (SD 72118 20612) approximate length 134 metres, and having a width of 1.8 metres.

Footpath 226 Darwen

From Point B (SD 72054 20721) in a generally southerly direction to Cuckoldman’s at Point A (SD 72044 20697), approximate length 24 metres, and having a width of 1.8 metres.
