NOTICE is hereby given that the Health and Safety Executive, being the
Building Control Authority and Regulator, has received an application under
Section 8(3A) Building Act 1984 to relax or dispense with a requirement
under building regulations.
The Situation and Nature of the Work: Former Adur Civic Centre, Ham Road,
Shoreham by the Sea, BN43 6PR
New build concrete frame buildings, SFS infill and masonry external skin
Building A is affordable Housing 53 No. units & 1 No. commercial unit
Building B is shared ownership housing 106 No. units & 2 No. commercial
units. This notice applies to Building B only. Meaningful work commenced on
site on the 26th May 2023 and met the 15th June 2023 deadline for
transitional requirements of the amended building regulations 2022. Building
B transitioned to the Building Safety Regulator (Health and Safety Executive)
as building control body in January 2024 and at this time the full
amendments of the building regulations 2022 applied to the building. The
applicant is seeking a relaxation to return the requirements to the standards
in force when the building was designed and work commenced.
The requirements of The Building Regulations 2010 to be relaxed:
 Regulations 24 and 25 (to relax methodology of calculation and
expression of energy performance of buildings). Methodology to be
applied will be SAP 2012, as relevant at the time of the original deposit of
plans with the Local Authority.
The requirements of The Building Regulations 2010 to be dispensed with:
 Regulations 26C and 27C (to dispense with the regulations requiring a
building does not exceed the target primary energy rate, and requiring
Target Primary Energy Rate calculations, respectively)
 Regulation 44I ( to dispense with the regulations in relation to the
Infrastructure of Charging Electric Vehicles for a new mixed-use building
or a mixed-use building undergoing major renovation)
 Part L2 of Schedule 1 (the need for measuring the On-site generation of
electricity)
 Part O of Schedule 1 (the requirement for Overheating Mitigation)
 Part S6 of Schedule 1 (Infrastructure for the Charging of Electric Vehicles
in the erection of new mixed-use buildings and mixed-use buildings
undergoing major renovation.
The Regulator considers that the operation of a requirement in building
regulations would be unreasonable in relation to the particular case and is
considering the issue of a direction dispensing / relaxing the requirements
above, as specified.
Representations to the Regulator with regard to the effect that the direction
may have on public health or safety may be made by: Friday 17th October
2025.
