What is planned?

TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 2015, AS AMENDED

NON-IMMEDIATE DIRECTION MADE UNDER ARTICLE 4(1)
TO WHICH ARTICLE 6 APPLIES

NOTICE IS GIVEN that TUNBRIDGE WELLS BOROUGH COUNCIL made a Non-Immediate Direction on 23rd September 2025 under Article 4(1) of The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended)

The Non-Immediate Direction relates to development consisting of

(i) The Non-Immediate Direction relates to development consisting of the use of the land, other than a building, as a caravan site in the circumstances referred to in paragraph A.2. being development comprised within Class A of Part 5 of Schedule 2 to the said Order and not being development comprised within any other Class.

(ii) Paragraph A.2 defines - The circumstances mentioned in Class A are those specified in paragraphs 2 to 10 of Schedule 1 of the Caravan Sites and Control of Development Act 1960 (cases where a caravan site licence is not required), but in relation to those mentioned in paragraph 10 do not include use for winter quarters.

The Non-Immediate Direction removes permitted development rights for this type of development from the date it comes into force namely 8th November 2025 Planning permission will therefore be required for development consisting of :-

(i) The use of the land, other than a building, as a caravan site in the circumstances referred to in paragraph A.2. being development comprised within Class A of Part 5 of Schedule 2 to the said Order and  not being development comprised within any other Class.

(ii) Paragraph A.2 defines - The circumstances mentioned in Class A are those specified in paragraphs 2 to 10 of Schedule 1 to the Caravan Sites and Control of Development Act 1960 (cases where a caravan site licence is not required), but in relation to those mentioned in paragraph 10 do not include use for winter quarters of Schedule 2 to the said 2015 Order (as amended) at Shearnfold Wood, Church Road, Kilndown, Cranbrook, Kent as shown on the map attached to the Direction on and after this date.

Representations may be made concerning the Article 4 Direction between 26th September 2025 and 7th November 2025 inclusive. If you wish to make representations you may do so by email to Planning@TunbridgeWells.gov.uk or by post to the Head of Planning Services, Tunbridge Wells Borough Council, Town Hall Civic Way Royal Tunbridge Wells Kent TN1 1RS. Any representations must be received by 5pm on 7th November 2025.

The Non- Immediate Direction comes into force on 8th November 2025 subject to being confirmed by the Council pursuant to paragraph 1(10) of Schedule 3 to the said Order.
