What is planned?

PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990

Notice is hereby given that Swale Borough Council, in pursuance of its powers under section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990, has determined that the following area, as more fully described in the Schedule to this notice, are areas of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance, and that following a recent review and associated public consultation, the Council has accordingly re-designated Preston-Next-Faversham Conservation Area.

The main effects of the designation of a Conservation Area are as follows:

(1) Planning permission is required for the total or substantial demolition of all unlisted buildings (other than excepted buildings) in the area.

(2) Trees within the Conservation Area are given special protection.  It is an offence to cut down, lop top or uproot a tree, subject to certain exceptions, within the Conservation Area without giving at least 6 weeks’ notice of intent in writing to the local planning authority.

(3) Permitted development rights under the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), are more restricted within a Conservation Area.

(4) In carrying out its function under the Planning Acts, the Council is required to pay special attention to the desirability of preserving or enhancing the character or appearance of the area.

(5) Planning applications for development which would, in the opinion of the local planning authority, affect the character or appearance of the Conservation Area must be given publicity, and representations received as a result of the publicity must be taken into account in determining the application.

(6) It is the duty of the local planning authority from time to time to formulate and publish proposals for the preservation and enhancement of the Conservation Area.

The existence of the Conservation Areas referred to in the Schedule below will be revealed by Local Land Charge Searches against properties included in the areas.
