REDEVELOPMENT AT EASTFIELDS ESTATE (PHASE 2) AND STOPPING UP ORDER NO. 1 2024 NOTICE OF MAKING OF STOPPING UP ORDER SECTION 247 TOWN AND COUNTRY PLANNING ACT 1990

NOTICE IS HEREBY GIVEN that on 31st July 2025 the Council of the London Borough of Merton, Civic Centre, London Road, Morden, Surrey, SM4 5DX (hereinafter called “the Council”) made an order (“the Order”) pursuant to section 247 of the Town and Country Planning Act 1990 (hereinafter called “the Act”) in respect of:

The existing highways relating to Eastfields Phase 2 made up of the carriageway and footway areas for Pains Close, Clay Avenue and Potter Close on the Eastfields estate in Mitcham comprising of an area of 13.6 m² as shown edged red on the attached plan (“the Footpaths”)

The effect of the Order is that the Footpaths have ceased to be public highway.

The Council is satisfied that it was necessary to stop up the Footpaths that are subject to this Order to allow for the implementation of the planning permission described in the Schedule.

A copy of the Order and a map defining the land to which it relates can be inspected at Council Offices at Front Reception, Merton Civic Centre London Road Morden Surrey SM4 5DX, from 9.00am to 5.00pm Monday to Thursday and 9.00am to 4.45pm on Friday (excluding bank and public holidays).

Any person aggrieved by the Order and wishing to question its validity, or any provision contained in the Order, on the grounds that it is not within the powers of the Act or that any procedural requirements of the Act or any regulation made under the Act has not been complied with in relation to the making of the Order may, within 6 weeks following 31st July 2025 apply to the High Court for the suspension or quashing of the Order or of any provision contained in the Order.

Description of Development

The regeneration of the Eastfields Estate comprising the demolition of all existing buildings and structures; erection of new buildings ranging from 1 to a maximum of 9 storeys providing up to 800 residential units (C3 use class); provision of up to 275 sqm of non-residential floorspace (flexible use classes A1 and/or A2 and/or A3 and/or A4 and/or B1 and/or D1 and/or D2) provision of new public open space and communal amenity spaces including children’s play space; new public realm, landscaping works and new lighting; cycle parking spaces (including new visitor cycle parking) and car parking spaces (including within ground level podiums), together with associated highways and utilities works.
