Notice Of Non-Immediate Article 4 Direction Made Under Article 4(1) Of The Town And Country Planning (General Permitted Development) (England) Order 2015

Wigan Borough Council have made the Non-Immediate Article 4 (1) Direction on 15th July 2025, under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 ("the Order").

The Direction relates to land within the borough and removes the change of use of a building from a use falling within Class C3 (dwellinghouses) of the Schedule to a use falling within Class C4 (houses in multiple occupation) of that Schedule, development comprising Class C4 (houses in multiple occupation) is permitted development by virtue of provisions within Class L of Part 3 of Schedule 2 to the Order being development for which planning permission is not required. Subject to confirmation the Direction will come into force on 31st August 2025, should it be confirmed.

This means that after the 31st of August 2025 the change of use from Class C3 (dwellinghouse) to Class C4 (HMO) requires planning permission in the Borough of Wigan.

A copy of the Article 4 (1) Direction and a plan showing the area to which it relates may be inspected during normal business hours at the Town Hall, Library Street, Wigan WN1 1YN, between the dates 22nd July 2025 and 12th August 2025, and via the Council's website at www.wigan.gov.uk.

A copy of the Article 4 (1) Direction and a plan showing the area to which it relates can also be requested and representations made to the local planning authority via emailing Housingdevelopment@wigan.gov.uk between the dates 22nd July 2025 and 12th August 2025.
