NOTICE OF CONFIRMING A NON-IMMEDIATE
DIRECTION UNDER ARTICLE 4 (1) PLANNING
DOCUMENTS




NOTICE IS HEREBY GIVEN that on 3rd
June 2025 Eastbourne Borough Council has
confirmed a Direction under Article 4(1) of the
Town and Country Planning (General Permitted
Development) (England) Order 2015 (“the
Order “).
The Direction withdraws the permitted
development rights granted by Class L(b) of
Part 3 of Schedule 2 of the Town and Country
Planning (General Permitted Development)
(England) Order 2015 for development
consisting of a change of use of a building from
a use falling with Class C3 (dwellinghouses) of
the Schedule to the Town and Country Planning
(Use Classes) Order 1987 to a use falling within
Class 4 (houses in multiple occupation) of that
Schedule and not being development comprised
within any other Class.
The effect of the Direction is that permitted
development rights for this type of development
are withdrawn and that a grant of planning
permission will therefore be required for a
change of use of a building from a use within
Class C3 of the Use Classes Order to a use
within Class C4 of the Use Classes Order in the
areas specified below.
The Direction relates to all land and buildings
within the defined areas being:
• All roads within the wards of Devonshire,
Meads and Upperton
• Both sides of Whitley Road and Seaside in St
Anthonys ward
In accordance with the Town and Country
Planning (General Permitted Development)
(England) Order 2015 the Direction shall come
into force on 30th July 2025.
