Notice of adoption Norfolk Minerals and Waste Local Plan 2023-2038

Norfolk County Council adopted the Norfolk Minerals and Waste Local Plan (NMWLP) on 20 May 2024.

The NMWLP is part of the Development Plan for Norfolk. It covers the whole of the County of Norfolk and will enable the provision of a steady and adequate supply of minerals and sufficient waste management facilities during the plan period to 2038. It forms the basis for determining relevant planning applications and it supersedes the currently adopted NMWLP (January 2022). The Inspector’s report was issued on 21 March 2024. The adopted NMWLP incorporates the main modifications recommended in the Planning Inspector’s Report, and Additional Modifications made by Norfolk County Council.

Any person who is aggrieved by the Norfolk Minerals and Waste Local Plan may apply to the High Court under section 113 of the Planning and Compulsory Purchase Act 2004 for permission to apply for a judicial review of the decision to adopt the Norfolk Minerals and Waste Local Plan.

The grounds for such an application can only be that:

a. the document is not within the appropriate power and/or

b. a procedural requirement has not been complied with.

An application for permission must be made promptly in the High Court, and in any event not later than the end of the six-week period beginning with the date of adoption i.e. 20 May 2024.
