CONFIRMATION OF DIRECTION MADE UNDER ARTICLE 4(1) TO WHICH PARAGRAPH 1 OF SCHEDULE 3 APPLIES
RELATING TO LAND LAND TO THE SOUTH OF WEST ASHLING ROAD, WEST ASHLING, CHICHESTER, WEST SUSSEX
ISSUED BY: CHICHESTER DISTRICT COUNCIL (“the Council”)
TAKE NOTICE that the Chichester District Council has made a Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 relating to Land South of West Ashling Road, West Ashling, Westbourne, West Sussex
The District Council is satisfied that it is expedient that development of the description set out in the First Schedule hereto should not be carried out on the said land unless permission therefore is granted on an application made under Part III of the Town and Country Planning Act 1990 (as amended).
The effect of the Direction is that permission granted under Article 3 of the said Order shall not apply to development of the description set out in the First Schedule below on the land specified in the Second Schedule below.
The Direction was CONFIRMED and came into force on 2nd of May 2025 in accordance with paragraphs 1(9) and 1(10) of the said Order.
A copy of the confirmed Direction and a copy of the plan defining the land to which it relates may be viewed at Chichester District Council offices, East Pallant House, East Pallant, Chichester, West Sussex, PO19 1TY between the hours of 9am and 4pm Monday to Friday. FIRST SCHEDULE
Use of Land as Caravan Site
The use of land, other than a building, as a caravan site in the circumstances referred to in paragraph A.2. being those specified in paragraphs 2 to 10 of Schedule 1 to the Caravan Sites and Control of Development Act 1960 (cases where a caravan site licence is not required), but in relation to those mentioned in paragraph 10 do not include use for winter quarters, being development comprised within Schedule 2, Part 5 – Caravan Sites and Recreational Campsites, Class A, of the Town and Country Planning (General Permitted Development) (England) Order 2015
Use of Land by Members of Certain Recreational Organisations
The use of land by members of a recreational organisation for the purposes of recreation or instruction, and the erection or placing of tents on the land for the purposes of the use, being development comprised within Schedule 2, Part 5 - Caravan Sites and Recreational Campsites, Class C, of the Town and Country Planning (General Permitted Development) (England) Order 2015
Agricultural Development on Units of less than 5 hectares
The carrying out on agricultural land comprised in an agricultural unit, of not less than 0.4 but less than 5 hectares in area, of development consisting of the provision, rearrangement or replacement of a private way; the provision of a hard surface and the deposit of waste, where the development is reasonably necessary for the purposes of agriculture within the unit, being development comprised within Schedule 2, Part 6 - Agricultural and forestry, Class B, of the Town and Country Planning (General Permitted Development) (England) Order 2015
