NOTICE OF PUBLIC PATH AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDERS HIGHWAYS ACT 1980, WILDLIFE AND COUNTRYSIDE ACT 1981

NOTICE OF MAKING OF PUBLIC PATH AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER

The Oxfordshire County Council, Marsh Baldon Footpaths Nos. 4 & 9 (parts), Public Path Diversion and Definitive Map and Statement Modification Order 2024

The Order made on 14 October 2024, if confirmed as made, will modify the Definitive Map and Statement for the area by diverting, as shown on the Order map: - Marsh Baldon FP4 running from OS Grid Ref SU 5659 9876 south-eastwards to 238m to SU 5672 9856, and then southwards for 97m to SU 5673 9847 to a new line running from OS Grid Ref SU 5659 9876 south-south-eastwards for 239m to SU 5670 9855, southwards via SU 5671 9853 for 82m to SU 5671 9847, and eastwards for 11m to SU 5673 9847; Marsh Baldon FP9 running from OS Grid Ref SU 5651 9847 eastwards for 42m to SU 5655 9847, southwards for 63m to SU 5656 9840, south-south-westwards for 71m to SU 5654 9833, south-south-eastwards for 70m to SU 5655 9826 and south-south-westwards for 58m to SU 5653 9821 to a new line running from OS Grid Ref SU 5651 9847 south-south-eastwards for 145m to SU 5654 9833, and south-south-westwards for 163m to SU 5653 9821.

Representations about or objections to the Order may be sent in writing to Countryside Access Legal, Oxfordshire County Council, County Hall, New Road, Oxford OX1 1ND or countrysideaccesslegal@oxfordshire.gov.uk no later than 23 May 2025. Please state the grounds on which they are made. If no such representations or objections are duly made, or if any so made are withdrawn, the Oxfordshire County Council may confirm the Order as an unopposed Order. If the Order is sent to the Secretary of State for Environment, Food and Rural Affairs for confirmation, any representations or objections which have not been withdrawn will be sent with the Order.

NOTICE OF CONFIRMATION OF PUBLIC PATH AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDERS

  1. The Oxfordshire County Council, Great Tew Footpath No. 1 (part), Public Path Diversion and Definitive Map and Statement Modification Order 2024

  2. The Oxfordshire County Council, Great Tew Footpaths No. 8 (part), No. 24 & No. 25, Public Path Creation and Definitive Map and Statement Modification Order 2024

On 03 February 2025, the Oxfordshire County Council confirmed the above Orders under sections 119 and 26 of the Highways Act 1980 respectively and section 53A(2) of the Wildlife and Countryside Act 1981.

The effect of the Diversion Order as confirmed is to modify the Definitive Map and Statement for the area by diverting, as shown on the Order map: -

Great Tew FP1 running from OS Grid Ref SP 3953 2927 south-south-westwards for 363m to SP 3929 2899 and westwards for 61m to SP 3867 2898 to a new line running from OS Grid Ref SP 3953 2927 south-south-westwards for 230m to SP 3932 2917 and southwards for 208m to SP 3927 2888.

The effect of the Creation Order as confirmed is to modify the Definitive Map and Statement for the area by creating, as shown on the Order maps: -

Great Tew FP8 running from OS Grid Ref SP 3941 2996 south-eastwards for 66m via SP 3967 2999 and SP 3971 2978 to the junction of Great Tew FP 9 and 18 at SP 3984 2976; Great Tew FP24 running from Great Tew FP 1 at OS Grid Ref SP 3932 2917 west-north-westwards for 27m to the B4022 opposite Butlers Hill at SP 3930 2918; Great Tew FP25 running from Great Tew FP1 at OS Grid Ref SP 3953 2927 north-north-westwards for 61m to SP 3950 2932 and north-westwards for 171m to the lane at SP 3939 2957 opposite Great Tew Lodge.

Any person aggrieved by the Diversion or Creation Orders who wishes to question the validity of the Orders or of any of their provisions on the grounds that it is not within the powers of the Highways Act 1980, the Wildlife and Countryside Act 1981 (WCA) or on the grounds that any requirement of the 1980 Act, as applied by section 26 and 118 of the Act, or any regulation made under the Acts has not been complied with in relation to the Order, has a right to make an application to the High Court under the above Acts within six weeks from 24 April 2025.
