PROPOSED PORTS OF FLEETWOOD AND SILLOTH
(TRANSFER OF UNDERTAKING) HARBOUR REVISION ORDER
NOTICE OF APPLICATION FOR A HARBOUR REVISION ORDER
NOTICE IS HEREBY GIVEN that Associated British Ports (“the applicant”) has applied
to the Marine Management Organisation (“the MMO”) for a Harbour Revision Order
under section 14 of the Harbours Act 1964.
The proposed order would –
• provide for the establishment of FJ Ports (Fleetwood) Ltd. as the harbour authority
for the Port of Fleetwood (in place of the applicant), and
• provide for the establishment of FJ Ports (Silloth) Ltd. as the harbour authority for
the Port of Silloth (in place of the applicant).
In connection with the establishment of FJ Ports (Fleetwood) Ltd. as the harbour authority
for the Port of Fleetwood the Order would –
• transfer to FJ Ports (Fleetwood) Ltd. all statutory and other powers and duties relating
to the Port of Fleetwood to FJ Ports (Fleetwood) Ltd.,
• transfer to FJ Ports (Fleetwood) Ltd. the undertaking of the applicant at Fleetwood
which existed immediately before the transfer,
• provide for any byelaws etc. made in relation to the Port of Fleetwood to continue
to have effect as if made by FJ Ports (Fleetwood) Ltd. immediately after it becomes
the harbour authority for the Port of Fleetwood,
• provide for all contracts etc. entered into by the applicant in relation to the Port of
Fleetwood immediately before its transfer to FJ Ports (Fleetwood) Ltd. to be binding
on and enforceable against FJ Ports (Fleetwood) Ltd. following the Port’s transfer,
and
• provide for all legal and other proceedings in relation to any property etc. transferred
to FJ Ports (Fleetwood) Ltd. under the Order and begun before the transfer to be
carried on by that company.
In connection with the establishment of FJ Ports (Silloth) Ltd. as the harbour authority
for the Port of Silloth the Order would-
• transfer to FJ Ports (Silloth) Ltd. all statutory and other powers and duties relating to
the Port of Silloth to FJ Ports (Silloth) Ltd.,
• transfer to FJ Ports (Silloth) Ltd. the undertaking of the applicant at Silloth which
existed immediately before the transfer,
• provide for any byelaws etc. made in relation to the Port of Silloth to continue to have
effect as if made by FJ Ports (Silloth) Ltd. immediately after it becomes the harbour
authority for the Port of Silloth,
• provide for all contracts etc. entered into by the applicant in relation to the Port of
Silloth immediately before its transfer to FJ Ports (Silloth) Ltd. to be binding on and
enforceable against FJ Ports (Silloth) Ltd. following the Port’s transfer, and
• provide for all legal and other proceedings in relation to any property etc. transferred
to FJ Ports (Silloth) Ltd. under the Order and begun before the transfer to be carried
on by that company.
The Order also provides a saving for Trinity House and Crown Rights.
The proposed order would not authorise the construction or alteration of a project
or confer development consent. Accordingly, Council Directive 85/337/EEC on the
assessment of the effects of certain public and private projects on the environment (as
amended) which is codified by Council Directive 2011/92/EU (as amended by Directive
2014/52/EU) does not apply to the proposals and no environmental statement has been
supplied.
A copy of the draft order and accompanying documents is deposited at the offices of the
applicant at:
• The Port of Fleetwood, Port and Marina Office, Fleetwood, Lancashire FY7 6PP, and
• The Port of Silloth, Port Office, Silloth, Cumbria CA7 4JQ.
These may be inspected at all reasonable hours until Monday 2 June 2025.

offices of the MMO in Newcastle Upon Tyne by appointment at the email address below
or may be viewed on the MMO’s website at:

Any person desiring to make an objection or representation concerning the appli-
cation should write to the Harbour Orders Team, Marine Management Organisation,
Lancaster House, Hampshire Court, Newcastle Upon Tyne NE4 7YH or email to
harbourorders@marinemanagement.org.uk.
An objection or representation should:
i. be received before the expiry of a period of 42 days starting with the date at the foot
of this notice (but see the last paragraph of this notice below);
ii. be made in writing quoting reference HRO/2025/00004;
iii. state the grounds of the objection or representation;
iv. indicate who is making the objection or representation; and
v. give an address to which correspondence relating to the objection or representation
may be sent.
The MMO will pass to the applicant a copy of any objections and other representations
received.
If an objection is duly made and not withdrawn then the MMO may cause an inquiry to
be held. Any objections duly made and not withdrawn and any representations duly made
will be considered before the MMO decides whether or not to make the order.
The statutory 42-day public consultation on the HRO starts on 16 April 2025. As the
public notice for the Port of Silloth is not advertised until 18 April 2025, the MMO is
agreeable to consider consultation responses for a further 2 days beyond the consultation
deadline. Furthermore, as this 42-day consultation will run across 4 public holidays,
the MMO is agreeable to consider consultation responses received up to a total of 6 days
beyond the 42-day consultation period. The final date for consultation responses to be
received is therefore 2 June 2025.
