Town & Country Planning (Environmental Impact Assessment) Regulations 2017

Notice is hereby given that Essex County Council has received two planning applications from Indaver Rivenhall Limited at land at Rivenhall Airfield, Coggeshall Road, Braintree, CO5 9DF for Planning Application 1 –

Ref. ESS/23/25/BTE

Continuation of development of the Integrated Waste Management Facility (IWMF) permitted by ESS/39/23/BTE without compliance with conditions:

  • Deletion of condition 17 (requirement for no visible plume from stack) and

  • Deletion of condition 39 (1900 to 2300 hours noise limit), and amendments to the following conditions: Condition 2 (approved drawings and documents – to allow amended drawings and documents); Condition 3 (HGV movements – to extend waste deliveries hours by the Waste Disposal Authority; Condition 6 (vehicle access – to allow non-HGVs to access via Woodhouse Lane); Condition 15 (design – to allow phased submission of details); Condition 18 (green roof – to allow reduction in green roof area); Condition 19 (details process equipment or plant – to allow phased submission of details); Condition 21 (parking provision – to allow phased provision); Condition 23 (surface water drainage – to retain the rising main); Condition 26 (paper pulp plant – to allow amendment to process water); Condition 27 (origin of wastes – to remove Essex and Southend restriction); Condition 29 (waste inputs – amend calculations and types allowed to be imported); Condition 35 (out of hours construction works – to allow specified works to be carried out between 1900 and 0700 hours); Condition 36 (weekday delivery hours – to amend waste delivery hours); Condition 38 (noise limits – to allow 2300 hours to 1100 and 0700 hours limits until 2030); Condition 40 (noise limits – to allow asymmetric periods change from the 5 to 1; Condition 41 (tonnage limits – to allow weekend operation); Condition 43 (offsite landscaping – to allow phased provision and to make it clear that the condition relates to mitigation of offsite lighting and should be an updated monitoring period); Condition 43 (inclusion of conditions under consolidated application); Condition 44 (lighting details – to allow phased submission and details shared with highway operational features), Condition 51 (bust – to allow phased lighting submission); Condition 52 (topsoil – to allow phased submission of details); Condition 54 (habitat management plan – to allow changes to the condition); Condition 56 (stack – amend to allow non-visible plume subject to air quality limits and monitoring – to allow changes to the technology); Condition 59 (building and planting – to allow inclusion of permitted NMA); Condition 61 (parking area – to allow minor modification); Condition 65 (green roof design and planting – to allow changes to roof condition); Condition 66 (Woodhouse Farm – to extend timescale for completion of refurbishment); and

  • Addition of the following new conditions: Condition 70 (phasing – to include phased delivery); and

  • Condition 71 (refurbishment – to allow inclusion of works associated with the following new conditions).

Planning Application 2 – Ref. ESS/24/25/BTE Outline Planning Permission with all matters reserved apart from access for the construction of a Carbon Capture, Usage and Storage Plant and Heat Offtake (CCUS+HO) and associated development at Rivenhall Airfield, in connection with the IWMF development.

Also, an associated Non-Material Amendment application has been submitted

Ref. ESS/39/23/BTE/NMA13 for: Non-Material Amendment to the Description of Development of planning permission ESS/39/23/BTE to remove reference to materials processed within the IWMF, together with the re-wording of Condition 29 to include reference to materials processed within the IWMF. ESS/39/23/BTE is an amended planning permission for the Rivenhall Integrated Waste Management Facility (IWMF).

The proposals may affect the setting of Woodhouse Farm, associated building and pump which are all Grade II Listed Buildings.

The proposed developments may not accord with the provision of the Essex and Southend Waste Local Plan adopted 2017 and the Braintree District Local Plan adopted 2022 in force in the area within the land to which the applications relate is situated.

Members of the public may inspect copies of the applications and other documents submitted with it (including the Environmental Statement) online at https://planning.essex.gov.uk.

Consultation on these applications is open until 10 May 2025.

For as long as stock lasts, a memory stick of the Environmental Statement is available for £15, or a hard copy for £810 or a copy of the Non-Technical Summary is available free of charge from regenecon@quod.com quoting Reference No. 0230190.
