We give notice that Wain Homes (South West) Limited is applying to Cornwall Council to modify the planning obligation described below:

The obligation to transfer highway improvement land contained in a section 106 agreement dated 7 July 2004 made between (1) Carrick District Council; (2) Wain Homes (South West) Holdings Limited and (3) Vospers of Truro Limited (as varied by a deed of variation dated 18 September 2007 and made between (1) Carrick District Council and (2) Wain Homes (South West) Holdings Limited and a deed of variation dated 31 August 2011 and made between (1) The Cornwall Council; (2) Kim Rundle and (3) Wainhomes (South West) Holdings Limited). |

Any person against whom the planning obligation is enforceable who wishes to make representations about this application should write to the Council at New County Hall, Treyew Rd, Truro TR1 3AY (FAO Planning Department) within 21 days.
